She's not. Kagan seems to be one of the smart ones. She's purposely playing devils advocate in a way for the witness to be redirected away from a weak argument.I find it interesting that even Kagan is poking holes in the state's argument.
It seems to me that if Trump is barred from being on the ballot based, not on having been duly convicted in court of insurrection, but on feelings and political motivation, then in the future this could lead to any candidate being removed from the ballots for whatever reason by the individual states.
It's a total breakdown in our law and order. Ushers in more of a propensity to just follow whatever and not uphold the laws because you don't like them. It's like the NASDAP and Brownshirts. I don't know why republican AGs aren't waging lawfare against biden, and all democrat candidates, in the same way they're going after trump. It's not like there's a shortage of democrats urging blm/antifa to wage political violence on the record.yep.
