OP, thanks - I frequent another shooting forum where there is a member who appears at times to want to see the ATF get away with making up “rules” as they please …

The interesting bit is the court incorporating "common use" as a big part of the argument. So many nasty machine bits are in common use, from semi-auto anything to magazines of normal capacity to pistol braces.

I wonder if ATF giving out free tax stamps will turn around and bite them in their SBRs. Anybody have the figures on how many suppressors are currently in "common use"?

I believe this one is national because it's not a finding on constitutionality, it's a finding that ATF violated the Administrative Procedures Act, and therefore the rule simply isn't valid because it wasn't within ATF's authority to promulgate it as they did.
