It won't go into effect until October if passed. I certainly hope we have a PI by October.
You can't even go to court to ask for a TRO and PI until the law actually takes effect, because until then you don't have standing to sue. So while we may get a TRO in the first few weeks of October, there will be some time where the law is in effect.

I believe you can ask for a PI beforehand because there is no stopping the law from becoming effective once it is signed. The judge in the Kolbe case admonished Kolbe for waiting for the law to take effect. There is no need to ask for a TRO because there is nothing to restrain before the law is in effect. This allows the court more time to make the decision.

Didn't the standing issue derail the first attempt to get a TRO or PI for Antonyuk in NY, with the plaintiffs being then forced to wait until the law was in effect in order to sue?

I admire the effort to get this repealed but I hate to say this for the 1000th time.... Maryland is a lost cause! Listen to me very carefully... Cut your losses and get outta there while you still can!

I believe standing did derail the first attempt, but I believe it was because they did not sue the right people and did not have the right plaintiffs

Yes, that is correct. We will bring suit as soon as we can after it is signed into law. It will take a few days.

Needed magic words: the plaintiffs carried in X location now prohibited and fully intend to continue to carry in X location after enactment but fear being arrested if they do so.

Edit...oops thought this was an SB1 thread not MoCo.
For sure. I carry in restaurants that serve alcohol. I don't drink, I just had a liver transplant! SB1 is a POS if the prohibition on carrying in restaurants that serve alcohol stands.

Yes, carry on proving the point…

Compromise? Tell ya what. Ill come over and flatten all of your tires. Or you give me 500 bucks. But if I were you, compromise with me , give me 250, and I’ll only flatten 2 tires. I’ll flatten the other 2 later no charge.
