Anyone see an application for 42 U.S. Code § 1983 here?

    Posts 28 and 207

It almost has to happen to get to the bottom of things. Yes the officers will have to be codefendants. Hopefully their professional liability insurance is paid up.

For last night, said that the Trespassing charge was actually what they should have been charged with last night.

I'm not sure how many folks MCP has actually had to arrest, both last night and this afternoon R&R & Deep Lurker made the officer put on the triplicate version of their citation that the location of the arrest was a "public sidewalk".

Can't leave that pesky LOCATION OF ARREST box empty doncha know....:lol2:

As I have said over and over again, given the vast number of laws on the books, one way or another they will figure out a way to charge any of us on any given day unless we fall in and comply with the governmental agenda.

I'm just reading they issued the guys additional citations today too? I wonder if anyone with a brain involved in that realizes that all that serves to do is make it look to all the world like they realized they were wrong last night and are now grasping at straws to try to make this a good arrest. I can tell you that's what it's going to look like to just about any judge. And I have a feeling the State's Attorney is not going to be impressed with this case either. That was just doubling down on stupid.

Per Stoveman, the Chief said that the State's Attorney will not receive any resistance from the police department if the State's Attorney decides to drop the charges. That speaks volumes.

I've seen clients charged with ridiculous stuff that the Assistant State's Attorney would not drop in court because the defendant and the officer had "exchanged words".

Thing is, this might get such a huge spotlight in Maryland that the State's Attorney will have no option but to try it. Not only that, but the defendants might want to try this versus accepting any type of plea deal short of a Nolle. If the defendants are actually convicted in Maryland District Court, this could be a case that receives national attention as it goes through the appeals process.

What is this next event, do clarify?

    when & where?

    Hundreds need to come.

It's spelled out a few pages back. I don't remember exactly so I won't try to relate it. Just start backtracking and you'll find it, or someone in the know will post.

You may recall the case of a MD CCW holder who was stopped in his vehicle one evening. He had business limitations on his permit. The officer called the MSP hotline to determine whether he was operating under is permit's restrictions; as it happened, MSP erroneously told the officer that the permit had been suspended. The gentleman spent the night in jail. When the true nature of the fustercluck came out, instead of apologising profusely for the false arrest and detention, the State's Attorney dreamed up a couple bogus charges to make it seem that the stop was legal and correct.

So this seems to be SOP for MD law enforcement: double down on their mistakes, and hope the hapless victim will roll over and plead out, in order to prevent being bankrupted by legal fees and lost time.

Of course we can't be sure, because MSP has failed to produce their current SOP for some time now. But don't worry - they may not know the law, but they know what they like.

On an earlier page, someone more in the know posted that a private room at Mission BBQ was reserved for the group. Since I'm new to the Patriot Picket scene, it seemed like a good place to start.

I'm sorry that I have been so slow to catch up today with all of my favorite people here--people who don't walk away when I am in handcuffs, people who sit by that triple-locked door until I am let go, people who want to know if I'm all right, if I am in pain, if I need something, if I need a hug, or a beer, or both. I love you guys.

And I love you too, Mrs.Rab1515 and all you other great gals who are piling in on this quest to do something greater than ourselves.

We have a Monday coming up that is calling all of us, pulling at us, hovering over us and tugging at us to gather on some Bricks where no one should be on a chain like a dog because the heart wants freedom, liberty, and pursuit of happiness.

We have a Monday coming up like no other Monday. Are you in? I know you must be in, because last Monday my head was bowed and I only saw my shoes. Next Monday, my head will be up.... and I need to see you.

Are you in? My heart says you are, but do you know it yet?

With miles to go before I sleep, let me see if I can answer some of your questions:

Were there any new signs displayed last night? Maybe something hit a nerve and we need to irritate it some more.

Yes, we debuted our new signs connecting the Democrat's obsession with Bump Stocks to the WORST kind of feel-good grandstanding while people die.

What happened to the Trespassing charges? Jeff, what do your charging papers say?

As mentioned earlier, we were charged with "a failure to obey a lawful order" that was about as unlawful as it gets. Then after media interviews earlier today, we were cited for two additional charges of "trespass" and "impeding citizen access to the Democrat Deathstar" (OK, I exaggerated a little bit, but yes, impeding)

Something else occurred to me, I wonder if there's a history of other groups being told to leave the sidewalk there or risk arrest?

Yes, we are relying on the photographic and googlegraphic memories of the big brains here to answer a question like this. But until that info dragnet materializes, I believe the answer would be "none".

Except it doesn't show anything leading up to the arrest. Do we have any video of that?

Oh yes indeed we do. We are saving the best for last.

Talk about trying to control the narrative "One had a gun", is this in print somewhere? Sounds like a lawsuit needs to be filed. This isn't true is it? I can't image PP brings a firearm to such an event.

My sense is this "Demonstrator With A Gun" thing started because nearsighted Leftists "spotted a holster" on me--except the holster wasn't on me, but on the officer standing directly behind me, cuffing me up. It never occurred to the shriekers that, from a distance, the holster on me belonged to the cop.

Abundance of caution....over-abundance of caution.....so much caution we declared martial law.

Yes sir, Maryland is leading the way in making sure that the shape of the "1st Amendent Zone" conforms EXACTLY to the shape of the "Safety Zone" so all peoples very happy.

My understanding is carry is legal until a LEO informs you that a public demonstration is taking place AND asks you to leave.

    https://law.justia.com/codes/maryland/2010/criminal-law/title-4/subtitle-2/4-208/

This comes up for people strolling across Maryland with a long gun.

so after this afternoons interview additional citations added to the brothers from Monday night? ?:sad20:

The scene that is public property?!?

pile on's from last night is my understanding

Not to worry, I've got a cool briefcase for my pile-ons that I will carry all the way to the Supreme Court.

Working on getting my schedule to allow me to pick my son up from school at 3 and get there before the pickets starts. 3.5 hrs from Garrett County. Obviously would love to be able to make it for dinner and to meet and greet everyone. I’ve been on the sidelines for too long and want to get involved. Also, want to use this opportunity to teach my 11 year old about what rights he has and for him to see first hand how civil action words in a representative republic. Although, MD is a very poor example at the moment. Jeff

I took a personal day and will be driving up from Salisbury. Planning to join with the Mission BBQ crowd.

God Bless you Jeff and TMR...it will be an honor to stand with folks who make a commitment like you are making. See you when you get to Annapolis.

And then there’s my great and good friend snallygaster who is coming in from five hours away to make Monday count. I am in awe of that.

All right, I'm caught up for another hour or so! See you right back here soon....

Nope, it all gets stored for a period of time from a company such as NetApp.
Ok. That is not the information I (and my attorney) were given after I was wrongfully charged with a traffic incident by MSP about 5-7 years ago.

I sent pics and video to VCDL President Phil Van Cleave.

    Not surprisingly, didn't hear back.

In all honesty, this is our fight, not anyone else's.

    No big deal.

But we are getting big time exposure

If they were really worried about the crosswalk safety, they would have found something more permanent and effective than that construction-site generator/light tower, I remember it being there in 2013 and it is still there in the video of the arrests. The lighting in the area is complete crap, but that is on the city to change, not the pedestrian, and it is always the driver's responsibility to yield to pedestrians.

If 5 people on a public sidewalk creates such a public safety hazard then there should be No Tolerance for "ANY" group to gather there , and possibly it should be shut down to ALL pedestrian traffic with officers posted there 24/7 to insure public safety.
