    Edit to my update:

    I asked the Chief why Sgt. Pope would not have simply explained the situation to us (as Blaster used in an example upthread) and gave a reason for the change in policy and if he thought that that would have diffused the situation somewhat? Asked if de-escalation of a situation is not SOP instead of just barking out where to stand or resist arrest?

    He said that yes, de-escalation was important and in their training but that some of his officers just seem to handle situations differently. I asked if Sgt Pope would face any disciplinary action after last night and he said that he would look into it.


    Did you mention the misuse of handcuffs and potential complaint for physical damages? Again Officer training needed or did they just come from washing out of TSA training?

    I would like to know exactly getting a citation for COMAR violation is. Talk about vague.

    Edit: Man... I can't keep up with this thread. I'm constantly 3 or 4 posts behind.

    For last night, said that the Trespassing charge was actually what they should have been charged with last night.

    I'm not sure how many folks MCP has actually had to arrest, both last night and this afternoon R&R & Deep Lurker made the officer put on the triplicate version of their citation that the location of the arrest was a "public sidewalk".

    Can't leave that pesky LOCATION OF ARREST box empty doncha know....:lol2:

    I'm just reading they issued the guys additional citations today too? I wonder if anyone with a brain involved in that realizes that all that serves to do is make it look to all the world like they realized they were wrong last night and are now grasping at straws to try to make this a good arrest. I can tell you that's what it's going to look like to just about any judge. And I have a feeling the State's Attorney is not going to be impressed with this case either. That was just doubling down on stupid.

    Bryan Sears posted on the Book of Faces that he saw a view with another political leaning recently demonstrating and passing out leaflets on the same sidewalk and was not forced to move.

    And who is that circled in red ?

    "Well, I wouldn't call them ticky tack, but if the States Attorney drops the charges they will not get any resistance from this office."

    The States Attorney isn't going to like this ... it makes them look stupid to support these citations ... especially with the shifting reasoning as Zoo pointed out. Also a trespassing on a public sidewalk charge makes the state look incompetent and wildly authoritarian.

    If the States Attorney was involved, there would have been a much more cogent argument from local law enforcement from the beginning. If local law enforcement also made this decision on their own, they also would have had a better plan of action. In addition, I think there would have been an effort to give the PP crew a heads up with what reasoning they were applying.

    When the Chief claimed the complaint wasn't "called in", it doesn't mean that a legislator or legislator's aide didn't speak directly to some of the officers on site. They moved quickly without a clear plan. The Chief is now scrambling to legitimize their actions, support his men, and not out whomever made the complaint (and in general, this is a good practice, except when law enforcement is being used as a tool to further a political viewpoint).

    If this gets any court time (meaning more media coverage), the state government and capital police are going to look pretty bad.

    Working on getting my schedule to allow me to pick my son up from school at 3 and get there before the pickets starts. 3.5 hrs from Garrett County. Obviously would love to be able to make it for dinner and to meet and greet everyone. I’ve been on the sidelines for too long and want to get involved. Also, want to use this opportunity to teach my 11 year old about what rights he has and for him to see first hand how civil action words in a representative republic. Although, MD is a very poor example at the moment. Jeff

    Gonna do my best to get the wife’s blessing on a school night. I feel very strongly about attending an event. Although I am fortunate to live in a sane conservative county, we are not immune to the punitive judgements handed down from those chosen few in Annapolis.
