USP Tactical is on the roster in .40 and .45 cals. You would only need to submit a caliber addition petition, no firearm required.

How does this work with the 10 rd mag restriction? Are they approving handguns that comes standard with a 15rd mag?

You can get a USP with 10rd mags from the factory. Not seen anything in the law that prevents a pistol with >10rd capacity being approved - the law simply affects sale and transfer of those magazines within state lines.

Correct. They don't look at potential magazine capacity when approving, and I would doubt they even check to see of 10 round mags are available for said firearm.
