Massachusetts is not that lucky.
They already have an AW ban. When the federal one expired in 2004 they continued theirs.
The people who already had them could keep them but have to get a license. But anything not already possessed by September 1994 is now banned.
The Westford, MA...
esq,
Thanks for answering my questions. Your reward is .....more questions. ;)
So because Illinois has no other option than to file for cert then they almost have to file for cert at SCOTUS?? (the only other option is conceding defeat which really isn't an option for Illinois)
Who do...
esq,
I am dying to know what this will mean for Chicago/Illinois and to a lesser extent for Kalachsky?
Does this mean that Illinois is out of options? I would have thought that rehearing En Banc was their last/best hope. Do you think the progunners in ILL should just wait out the timeframe...
Ok I am confused with your preference.
Help me make sense of this.
Moore = no carry of any kind
If moore goes before SCOTUS and asks "can the state gov have an absolute ban on carry"
SCOTUS answers narrowly "no the state gov can not have a complete ban on carry"
Illinois passes a NY/NJ/MD...
esqappellate,
Most of us are not familiar with the processes of CA.
If the orals are held in late October what is a "normal" time for them to release a decision?
The orals and decision will consist of a 3 judge panel correct?
How likely is it that the loser will request a enbanc...
Patrick,
While I don't necessarily agree with the tact that those guys have taken, what is the better way to make the public more used to seeing OC?
Maybe this is a topic for another thread but I would like your insight because it seems to me that you see things that the rest of us don't...
Patrick/Esq,
Quick question. You say that the people who applied back in march should be getting their permits. Why do you think that?
Esq has said that they will not go into contempt but cant they still just delay for a lot longer?
Judge Legg has given them no timeframe to actually...
ok let me see if I follow one part of their argument
if no stay is granted then the MSP would not know who has g&s and who does not. So when the 4th reverses they would have to revoke all permits issued during the interim.
(so I guess you cant keep a record of who has g&s and who doesnt?)...
esqappellate,
Thanks for the quick response and more importantly thank you for the inside look at how the court system works.
Most of us are mystified on the inner working of the legal system.
For example I did not know that the court does not sit every day or even every week. Now it...
Is the length of time from the last briefs to the time oral arguments are held because of a busy schedule at the CA?
I guess what I mean is why does it take 3 to 6 months from the time they read the briefs to when they next hear about the case?
Maybe I am a pessimist but I heard that last time Harry reid knew it didn't have enough votes to pass so he allowed some "blue dog" democrats to vote YES on it to look good for their voters and reelection campaigns.
So my fear is that we can't count on those same democrat votes this time around.
Can you elaborate on this post?
Senator Lugar was one of two republicans who voted NO on the last National Reciprocity bill. (Bill S. 1390 in 2009. Thune Amendment was No. 1618)
Are you saying it would be easier to get 60 votes on the Democrat Sponsored bill than the Thune bill. Do you...
Exactly. I had heard in other threads that he was responsive and nice to deal with. But on the other hand he is the one responsible for handguns permits as well.
Maybe there is a silver lining in this. When the MSP start processing permits without G&S at least we know who to make a very...
