This is where the rubber meets the road. We will now see how the lower courts react to the SCOUS's rulings.

    Let the games begin!!

I think most courts will go along with the changes with no problems. 5,6,8,10,11, and probably 4CA will probably transition smoothly for the most part. The outliers will almost certainly be the ones who have been problem children all along: 2, 3, and of course, 9CA. But a few per curiams should eventually knock them into line after a couple of years.

And Henderson in DC Circuit will probably need a personal visit from Justice Thomas with a taser somewhere along the line.

In Bruen, Thomas was, IMHO, gentle with judges in that he suggested they were not really guided with the immediate scrutiny and that Bruen set matters straight.

I personally think judges were looking for any reason to uphold anti-2A laws.

We shall see what integrity lower court judges actually have.

My take is that they are part of the government and would not rule to potentially give people the means to overthrow the apple cart.

I came here to post this, but in my heart I knew it had already been done.

The dicta in NYSRPA really should make this a cut and dry death blow to FSA 2013. Of course, it won't. But, maybe next session the justices will set them straight [again].

Because the Supreme Court has changed.
But it is likely going back to the District Court to find facts about history. It is the same starting point as if a new case is filed today. Tens of thousands of dollars in legal expenses were incurred for nothing.
