    The transcript for the February 6th motion hearing was finally released, so I "bought" it on PACER (<$25 per quarter is free and this was $9). Attaching it here, but it's also available directly from CourtListener for free since I use recap.

    I simply can't get over the Judge's unwillingness to do a TRO (Page 13, Lines 16-19):

    MR. PENNAK: I think the Court could issue a TRO simply on the 100-yard exclusionary --

    THE COURT: We're not doing a TRO; we're just doing a preliminary injunction here. I'm not going to do this twice.


    Excuse me, Judge? You don't want to "do this twice"? Sorry our constitutional rights might be an inconvenience for you.

    I find this outrageous, especially given the deprivation of a core constitutional right since this law was enacted last year.

    BTW, what's "recap"?
    RECAP is PACER spelled backwards. :) It's a browser plugin so that if you ever buy a PACER court document it automatically uploads it to RECAP. The RECAP copy is then used on CourtListener and probably all other such sites to provide a free copy of the document (if you look at a CourtListener page you'll see some documents have "Download PDF" and others have "Buy on PACER," depending on whether RECAP has a copy of the document). This way, hopefully, only one person ever has to pay for a document that should be free in the first place.

    Also, as I said, if your total purchases on PACER are under $25 for the quarter they don't actually charge you, they just mark it back to $0. The registration process isn't the best, but overall it's fine. Just remember to also get the RECAP plugin so everyone can read the documents.

    I consider it judicial activism more than cowardice. He knows he could have issued a TRO to preserve the status quo while this dragged on (given his apparently loaded case docket of other cases he's putting before this), but he made a deliberate decision not to do that and here we are many months later without a ruling on the preliminary injunction.

    He wants the process to be the punishment, even if he ultimately has to issue a ruling that's favorable to MSI.
