    Delaware Democratic leaders have introduced a bill to require residents to complete a firearm training course and obtain a permit before purchasing a handgun.

    Senate Majority Whip Elizabeth Lockman, D-Wilmington west, and House Majority Whip Melissa Minor-Brown, D-New Castle, introduced Senate Bill 2 on April 19. If signed into law, the bill would add Delaware to a growing list of states that require training and a permit prior to buying a handgun.

    Under SB2, most Delawareans could obtain a permit to purchase a handgun if they have completed an approved firearm training course in the last five years. Qualified law enforcement officers, qualified retired law enforcement officers and anyone permitted to carry a concealed deadly weapon would be exempt because they already have been required to complete training.

    Here's a new wrinkle;

    One notable change included in SB2 is a requirement that the Delaware Department of Safety and Homeland Security provide vouchers to cover the full cost of firearm training for anyone whose household earns less than 200% of the federal poverty guideline.

    “In 2021, we heard opponents argue again and again that the training requirement would create an undue financial burden for Delawareans living in low-income communities to obtain a handgun,” Lockman said in a press release. “The legislation I introduced today settles that debate by making access to a gun safety course absolutely free for anyone struggling to get by.”

    Basically, they were caught/exposed but fear not!

    “This legislation echoes the racist, old, tried and true gun control schemes of southern Democrats after the Civil War whose only goal was to keep guns out of the hands of those they wished to control,” the association posted on its Facebook page. “This legislation adds costs, barriers, restrictions and asking for permission to protect your family while violating multiple constitutional rights. There are so many issues with this legislation, but rest assured, DSSA will fight it at Legislative Hall and beyond.”

    SB2 is slated to be heard by the Senate Judiciary Committee Wednesday, April 26.

    I thought the growing "list of states" was for permit-less carry.

    It’s growing, just not quickly fortunately. OR passed permit to acquire firearms by ballot measure last year, but it’s stuck in the courts. WA tried to pass one this session, but it got watered down to just showing proof of training.

    The bill would mandate that permits can only be given to a person 21 years old or older who can’t be prohibited from buying a gun and can’t pose a danger of causing physical injury if supported by probable cause. That person also must complete a firearms training course within the last five years that meet certain requirements.

    That training must include
    instructions on safe handling of firearms and ammunition, safe storage of firearms and ammunition, and child safety. It must also include shooting fundamentals and skills, a review of state and federal laws, self-defense and confrontation management. The training also must include live fire shooting exercises conducted on a range using at least 100 rounds of ammunition.

    Delaware's Senate Democrat Leadership has once again put its loyalty to George Soros, Michael Bloomberg and the entities they so openly fund such as Everytown and Moms Demand Action before their loyalty to and respect for their constituents, their oaths of office, and the Delaware and federal constitutions. Their actions in support of Senate Bill 2, stand as solid evidence that they are content to do the bidding of a very vocal minority of voters, many of whom are not even from their districts, rather than do the bidding of the vast majority of the people of the State of Delaware.

    Yesterday stands as yet another day of infamy in the history of the Delaware Senate Democrat Caucus as yet another constitutionally oppressive “gun bill” was introduced – a bill that will do more harm to more law-abiding citizens than it will do good in addressing the rising levels of violent crime that continue to grow and plague our fair state from end to end.

    Yesterday, the sponsors of Senate Bill 2 released a press statement full of lies and half-truths, debunked theories and scientifically suspect studies, all in the hope of convincing their colleagues and constituents of the righteousness of their efforts.

    Senate Bill 2, the so-called Permit to Purchase Bill, purports to be another “common-sense public safety bill”. However, nothing could be farther from the truth.

    This bill, much like very similar legislation introduced last year, which passed the Senate only to fail in the House, is unconstitutional on its face on both the state and federal levels- and they know it.
    Senate Bill 2 would require law abiding citizens wishing to exercise their constitutional right to purchase a handgun to defend themselves, their homes and families to obtain a state-mandated permit prior to doing so. In order to obtain the permit, the citizen would have to complete a training course (almost identical to that for a concealed carry permit), be fingerprinted, submit to a background check and be approved by the Secretary of Homeland Security – all of which takes both time and money. A right delayed is a right denied.

    This proposed legislation serves as just another example of the sponsors not having the intestinal fortitude to take on the real causes of violent crime and to target the people that commit those crimes of violence. It is a fact that over 80% of all violent crime occurs in urban areas and is directly related to drugs and gangs, yet these senators refuse to address the root causes of such crimes.

    It is a well-known fact that criminals do not obey the law – that is why we call them criminals. These are the people that these senators should be targeting, not the law- abiding citizens at whom Senate Bill 2 is truly aimed.

    Senate Bill 2 requires law-abiding citizens to pay for the privilege of exercising their constitutional rights. Senate Bill 2 requires that citizens wishing to exercise their constitutional rights to be fingerprinted and go through two background checks before being able to purchase a handgun and then pay for a course most people do not need and which many have already completed.

    Article I, Section 20 of the Delaware Constitution states that; “A person has the right to keep and bear arms for the defense of self, family, home and State, and for hunting, and recreational use.”

    Senate Bill 2 would not only delay that right but allow an unelected state official to deny a citizen that right based on wholly subjective criteria. Based on the provisions of this proposed legislation it could take at least 60 days before a law-abiding citizen could exercise their constitutional right to keep and bear arms.

    The legal and practical problems with Senate Bill 2 are numerous and far-reaching, but the bottom line is that Senate Bill 2 will do nothing to reduce the levels of violent crime is Delaware nor will Senate Bill 2 have any impact on the number of suicides here in the First State.

    These Senators know, but are unwilling to admit, that the only truly effective method for combating violent crime is to hold those who commit violent acts accountable – that means quick and effective prosecution followed by prison sentences that are both meaningful and deterrent rather than policies such as those of the current Attorney General which result in feel-good plea bargains and a revolving-door criminal justice system.

    Finally, Senate Bill 2 is not only discriminatory but blatantly racist, disproportionately impacting the very citizens that are being most affected by violent crime. Contrary to the protestations of the bill’s sponsors, Senate Bill 2 will impose a heavy economic impact on those who can least afford it.

    The DSSA was instrumental in drafting the new Firearms Transfer Approval Program (FTAP) legislation that was passed and signed into law last year, about 10 months ago. FTAP is designed to address the very same issues cited by the sponsors of Senate Bill 2, yet it has not yet been implemented. Perhaps it is time to ask why the Carney Administration has yet to implement FTAP.

    Since its founding in 1968, the Delaware State Sportsmen’s Association has fought to protect and defend the rights of Delaware’s law-abiding hunters, gun owners, sportsmen and women. DSSA has a history of successfully defending those rights in court. Let there be no doubt, if SB 2 becomes the law of the land, DSSA will challenge that law in court.
    DSSA calls upon all law-abiding Delawareans to reach out to their senators and representatives and tell them to oppose SB 2. SB2 is not only bad law, but also bad policy as well.​

    I agree with you Audit, spoke to FFL's that were not for it, rather keep the NICS system. I opposed it @ DSSA meeting with Jeff be careful what you wished for and yet they walked into the trap with state run NICS check and now the permit system.

    Now they will have another court case to file ...............:mad54:

    I might as well move back, at least my handgun permit is still valid there (and didn’t involve jumping through all the hoops this bill proposes).

    Those in favor of a permit-to-purchase handgun law say it’s needed to stop gun violence on the streets. Those against it say gun laws already on the books should be enforced.
    Both sides aired their concerns April 26 during a Senate Judiciary Committee hearing on Senate Bill 2, legislation that would require anyone purchasing a handgun to first have a permit and training. The committee did not immediately take action to move the bill out of committee.
    Paul Johnstone, a veteran, said citizens should not have to fight for their rights under the Second Amendment and the Delaware Constitution. “There is a crime problem and that should be addressed,” he said.
    Karina Slater echoed a sentiment shared by many. “Common sense would be enforcing gun laws already on the books,” she said.
    Others said this new law will do nothing to prevent kids from obtaining handguns when current law already outlaws gun sales to those under 21.
    Those in favor of gun restrictions say the bill is needed to curb gun violence.
    Attorney General Kathleen Jennings said most illegal handguns used in violent crime across the state are purchased in Delaware in what is known as a straw purchase, and the permit law should keep more handguns off the streets. “It’s time to get the job done,” she said.
    Tracy Murphy, executive director of the Delaware Coalition Against Gun Violence, said she supports the bill to end gun violence and ensure gun owners are safe, responsible and accountable.
    “Gun violence is right now the No. 1 cause of death for children and teens in our nation and in our state. Gun violence is the No. 1 cause of death for Black men and boys in America,” she said.
    Under the bill, a person who wants to buy a handgun would need to take a training course and be fingerprinted, both at their own cost, and then apply for a permit from the Department of Homeland Security. For low-income individuals, a voucher program would be available to cover the costs for training and fingerprints. Officials said costs for training can vary from $200 to $500, and it costs about $60 to get fingerprints through the State Bureau of Investigation.
    Only people with a concealed carry permit, law enforcement officers or retired law enforcement would be exempt.
    So the AG freely admits that this is not about enforcing DE's Straw Purchase laws, and is about making it harder for citizens to obtain a handgun.

    Chief sponsor Sen. Elizabeth Lockman, suggested, however, that even criminals will obey the permit requirement if the bill becomes law.

    "Best of all, we know that every handgun owner in our state will have undergone a firearms training course," said Lockman, a Wilmington Democrat, adding that such training will reduce the numbers of accidental shootings, suicides and gun thefts.

    And a bureaucrat gets to decide if you are "worthy" to keep your gun if someone doxxes you.

    The SBI would have 30 days to investigate the person and grant a permit if the applicant is qualified. The agency would be allowed to retain information submitted by an applicant for an indefinite amount of time.

    If a permit is granted, it would be valid for one year under the substitute bill introduced Tuesday. Under the previous version, a permit was good for only 180 days. A permit can be revoked, and any guns purchased with it seized, if the director of the SBI later makes a determination "supported by probable cause," that the person poses a danger to himself or others by having a gun.

    The substitute bill allows up to 18 months for state officials to implement the permitting program, up from a maximum of six months under the previous version. The bill includes exemptions for active and retired law enforcement officers, and for those who already have concealed carry permits. It also provides for vouchers covering the full cost of a firearms training course for individuals with household income at or below 200% of the federal poverty guideline.
