    IANAL but I'm hearing grumblings the AACo Health Officer exceeded his authority. One would think that if he thought he had the power they wouldnt have waited for the Council to end the policy.

    I'm willing to bet this was planned when Pittman issued his "emergency order"...they wanted the Council vote for political cover, but are willing to assume power/control in the event Pittman was, rightly so, overruled.

    I wonder who will bring suit. The 4 Bolsheviks on the council agree with him doing it because it suits their agenda, and Rodvien has a JD so will have already thought this through from that standpoint.

    Guaranteed there was a plan with the 4 commies on the council, Pittman, and Dr. K.

    I fail to see how this is a nail in his coffin when he just said "fvck you" to the entire county council, 4 of whom agree implicitly in his actions.

    Further, the unwashed masses are championing this action "because science".

    All it has devolved into is "my side/their side" and these people only care about their idea of winning with no consideration for the tyranny that it is bringing.

    Again, my issue is not with what the council did or did not do. My issue is that an unelected technocrat with loyalty to Pittman who has empirically demonstrated that he cannot be entrusted with any sort of power.

    The hand wringers and doomers are welcoming this with open arms.

    They are now championing Dr. K as a hero of science overriding the council and the "Murica" crowd as it's now being couched.

    As depressing as that is, it's illustrative of the gap we regularly see for many issues. While the Conservatives may have the "moral high ground" (for lack of a better assessment), the Mommies Desperate for Attention and their ilk organize better to make the noise.

    If what Pittman said is true, (which I highly doubt) that means the health officer could do something like this on their own at any time with no approval from anyone. I find that very hard to believe.

    As I read the order, it seemed to draw authority from Hogan's new SoE, but IANAL

    IANAL either, but as I understand it, the county health officer has no authority to use or enforce State regs or mandates. The county health officer also has no authority to order anything, he can only make recommendations to the county executive, and any order based on those recommendations comes from the county executive. Pittman has already used up the legal time frame for his mask order, and the council voted not to extend it. That, legally, should be the end of it.

    If this is true, I don't doubt it is, and the GOP around here wasn't feckless and irrelevant. they would hold a news conference and explain exactly how this person doesn't have the authority to issue such an order. With state GOP leadership at their backs.

    But then I woke up from my fall on the ice and well.....

    Jesus, that's pretty broad powers to the Health Officer. Once you start declaring practically everything a "public health emergency" the abuses are limitless.
    Guns, racism, Big Macs, salt, sex. Next thing you know, we're living in "San Angeles" from the movie "Demolition Man."

    Did anyone see the breakdown of the votes? Amanda Fiedler emailed me back and said she didn't vote for a continuation of the mandate. I think she is a Democrat.
