HB1302 is truly a government sanctioned "it is OK to commit Hate Crimes against gun owners" bill.

Can't transfer 2013 preban Title 1 guns to anyone in MD and get them back.

A FFL and all of their inventory and customer guns are also at a huge risk doe to this law. If you don't understand what that means then you're not going to get an explanation.

The safest way to protect your property under this law is to make them all Title II and put them into a trust as an NFA item of some type. Have a trustee that does not live at your residence. If someone calls in an ERPO then all of the NFA items in that trust and be transferred to the other trustee and the police can't touch them. When this is done no transfer is taking place.

    I have a question.

I was told by someone here that was setting up trusts that I couldn't put my pre 13 , or any other, ar 15's in a trust because they weren't nfa items.

is that true or was I misinformed?

I'll believe that if it happens. Didn't they just pass definition of transfer involving more hoops to jump through just to do that?

Unless I misread it the new bill (law) says firearms must go to ffl or the police. Nothing about a family member being allowed to take them. And WHAT ABOUT AMMO??? Is there language anywhere that specifies who what when where why and how a persons .22 stash is treated?

The quote was alleged from a delegate that voted green. It didn't pass the sniff test here that would be an option. It's not like politicians say things that aren't so. I couldn't keep my insurance...

Does the law specifically provide for confiscation of ammo, magazines, or anything besides the actual firearms?

google is your friend, I am not.
I think people are mixing up bills. House bill 1646, which orders a judge to tell someone convicted of a disqualifying crime that firearms need to be transferred did pass - that bill allows family members (apparently) to take them. Guns are seized if you don't comply. Presumably if you are convicted, you are going to jail. That may or may not be a safe presumption in this state.

This bill 1302, does not allow transfers IIRC. LEO takes them.

Under the final bill, ammunition of any kind (even for firearms of types that the respondent does not possess) is seized, under the same terms as the firearms. The respondent is also prohibited from acquiring or possessing any new ammunition of any kind, during the duration of any ERPO. Adding ammunition was one of the Senate's enhancements to the bill sent over by the House in mid-March.

For more details, see the veto-seeking Action Alert.

Or any magazine that holds greater than 10 bullets.

It is not specifically mentioned in this bill, but I would expect the police will confiscate ALL of your ammunition and any other "dangerous weapons" in the vicinity of the firearms. So kiss your knife collection goodbye too.

Good luck getting any of that stuff back.

Curious myself. Might be a good idea to have a version of this bill/law that is easy for most to read so it can be shared ...

How does the average joe citizen know about these new laws??

HB1302 is an Extreme Risk Protection Order. The police are going to treat you as an Extreme Risk. You are TOTALLY EFF'd if someone swears one out on you and the popo show up at your house.

    Average Joe won't know.

Average Joe, not knowing, is going to kill the people coming for his guns.

Average Joe won't know whether they're real cops or just bad guys dressed up as cops.

Average Joe may feel he's been SWATed and will shoot first and hire a great defense lawyer second.

    Average Joe won't know.
    ...

Average Joe won't know why police kicked in his door, shot his dog and tasered him.

Average Joe won't understand why he and his wife are handcuffed and police have taken his children and are ransacking his house looking for weapons.

Average Joe won't understand that he lost his security clearance and his job because popo have labelled him as an Extreme Risk.

Average Joe will have to fight to get his kids back from social services.

They need to be NFA to be in a Trust (S.B.S., A.O.W., or S.B.R.).

I think this is important, people, when we advocate for Hogan to veto HB1302 that we don’t argue against things that are not even in this bill, like transferring guns and not being able to legally get them back because they’re pre-ban.

They need to be NFA to be in a Trust (S.B.S., A.O.W., or S.B.R.).

    thank you.

that's what I was told before

so if a man owns 15 pre 13 ar's that aren't nfa and a bunch of lowers then he's sol if the police come a knockin at 4am and they take them either nicely or by force.

and if md confiscates this property and its pre 13 you don't get them and your standard capacity mags back

this just reeks of a confiscation scheme, "we are sorry sir, your not crazy but we still cant give you your firearms back they are now non transferable"

Maryland truly sucks worse every day
