    I just got this email from AGC.

    AGC, MSI and Dealers Association File Lawsuit Against Maryland State Police

    Five Maryland citizens waiting delivery of their purchased firearms and three interested Maryland associations filed a complaint today in Baltimore County Circuit Court against the Maryland State Police (MSP) for the state's failure to process firearm applications within the seven days mandated by Maryland law.

    The MSP's failure to comply with its statutory duty -- which MSP has admitted is taking closer to 55 than the required seven days -- infringes the fundamental constitutional right of Maryland citizens to purchase and keep firearms for purposes of self-defense in their homes, as guaranteed by the Second Amendment to the United States Constitution, and puts them at risk while the bureaucracy takes its time to process citizen applications.
    The MSP's failure to issue approvals has caused significant economic harm to licensed firearms dealers in Maryland, who receive only a down payment for the firearm until MSP approval is received and possession is transferred. These business owners also risk civil or criminal sanctions if a firearm has been transferred to a purchaser whose application is later disapproved by the MSP.
    The lawsuit seeks a court order compelling the MSP to process all firearms applications in seven days as required by law.
    The complaint has been filed by five Maryland citizens awaiting their firearm purchases (including four women seeking handguns for self-protection in their homes), Associated Gun Clubs of Baltimore Inc. (an organization founded by World War II veterans in 1944 that promotes and provides training on firearms safety, firearm use and self-defense, has a strong history of defending the 2nd Amendment rights of all law-abiding citizens and actively promotes the private ownership of firearms for law abiding citizens), Maryland Shall Issue, Inc. (an all volunteer, non-partisan organization dedicated to preserving and advancing gun owners' rights in Maryland and educating the community about the right of self-protection, the safe handling of firearms, and the responsibility that goes with carrying a firearm in public), and the Maryland Licensed Firearm Dealers Association (an organization representing the constitutional and economic interests of numerous firearm dealer members in the State of Maryland as well as those of its members' customers and potential customers).

    Went to Dick's at lunch and bought Savage .22LR and 300 rounds (max they would sell) in 54 minutes. I couldn't take the wait anymore for my first firearm! I will be shooting this weekend, just not the PX4 in review.

    Went to On Target today to pick up my 2 firearms that I had purchased on 3/27. I filled out their waiver and walked out the door with them. They seemed happy to be able release them!

    THANK GOD FOR FFL's STANDING UP!!!

    The lawsuit is a great idea... maybe get MSP moving faster and actually following the current law. Funny how all of us law abiding citizens have to follow the gun laws as written but MSP and the people's republic of Md. can ignore the laws that are inconvenient whenever it benefits them.

    I purchased 3/15 and got my ND phone call Tuesday evening. Was completely shocked given the dates from everyone on the forum.

    Have a 3/21 I'm still waiting on.

    It doesn't hurt to ask...what do you have to lose? Just be respectful and courteous. I also think we might want to compile a list of the FFLs who will follow the law so in the future we can choose who we buy from or use for transfers.

    Couldn't agree more and a list would be most helpful. Not much help with my 3/10 BP purchase, but will with my 4/6 with Eakle if they elect to start releasing.

    I am no lawyer but I don't think the lawsuit will fly. MSP never told the FFL's not to release the firearms. And now some dealers are releasing them after 7 days.I do hope MSP will acknowledge that 55-90 days is to much and they need to figure out another system.

    I believe I read here that some FFL's have been told to wait until the NICS checks come back. Which would mean they "couldn't" release till 55-90 days etc. Could be wrong though.

    This isn't true. My FFL was told do not release until you get the ND by MSP

    Well you know the saying you can wish in one hand and piss in the other and see which one fill up first. I for one am thrilled that someone is standing up against the MST. If we don't at least try to do something we can be sure that nothing will change, and this will only get worse. Lets show them we are willing to keep fighting, I just donated to the cause and I suggest anyone who wants to put and end to this do the same. It is time to fight back and I will stand with anyone willing to do so.:mad54:

    Not sure what happened but my wife purchased at Bass Pro on 3/22/13, paperwork submitted to MSP on 3/23/13 got the call this morning to pick up. Hopefully the wait times are on the decrease but I think this was just an isolated case

    This was the MSP's position. I guess they say one thing ,but changed there minds. Some individual transfers where told to hold.

    The current backlog for the firearms background check is 50 days. The law
    states that the state has seven days to complete the required checks. On
    the eighth day if a dealer has not heard from MSP the dealer may release
    the firearm without penalty.Most dealers have decided to hold onto the guns pending the completed

    checks and we applaud their patience.
    The Maryland General Assembly took action by providing us additional
    manpower and technology to help alleviate the problem. But it takes time
    to hire qualified people and purchase the right software and equipment. We
    are working on it. The problem creating the backlog is a combination of
    record high volume gun sales, old technology and limited qualified
    personnel.

    I guess some dealers ran out of patience.
