MD AK SBR Question

    So, everyone knows AKs are now banned, but SBRs are not. Can one just register a 16" AK as an SBR to have an authentic-length AK?

    Nope. That would be perjury and falsely providing information to the ATF not to mention illegal under MD law as it would fall under rifle restrictions IE banned by name.

    ETA: One could theoretically build an AK pistol with a 16" barrel and never put a stock on it but that starts to get silly.

    Or if you could build a shoulder stocked 16in bbl with under 26in OAL. But with AK platform that's not physically possible.

    You could just have a dealer like Engage acquire and shorten whatever AK you want then transfer on Form 4. Or buy a receiver and file for a Form1 then build a 15.9" AK.

    According to BATFE, if you put a 16" or longer barrel on an SBR, it is no longer an SBR. And therefore would be a banned rifle in MD.

    You can use this to your advantage with ARs. If you want to go out of state, without an approved Form 20, you can put on a 16+" upper and take it anywhere as a normal rifle. Of course, if this upper is non-HBAR, do not assemble until outside MD. And do not take your short barrel upper with you.

    Cool. I appreciate the input. I had a feeling it couldn't possibly as simple as building a 16" and registering it as an SBR, but that sounds like a good alternative.
