I can't bring myself to read the decision.

I wish one of our lawyers would undertake a commentary and summary.

I’m not a MD lawyer, but the 4th Cir continues to be a place where the Constitution goes to die.

In this case, the 4th Cir said the arresting officer Pope should get qualified immunity:

“Because a reasonable officer in Pope’s position could have believed that the orders constituted lawful time, place, or manner restrictions on the picketers’ First Amendment rights, Pope is entitled to qualified immunity. We therefore reverse and remand with directions to the district court to enter judgment for Pope.”

Sad that when you are legally correct and you still are shit on. But the current state we are in, nothing surprises me.

I am so fed up with the heavy hand of local government and the federal system.
Freedom is all smoke and mirrors, you have freedom as long as you do what the government wants as soon as you go against that than you will be dealt with.

The decision will not pass constitutional muster. When Pope was deposed he should have been asked , have you seen or been on duty when protesters were in Annapolis? When he answers in the affirm, the next question, did you ever make an arrest of a protester in Annapolis for anything? Ever? He is a piece of crap. He deserves nothing. Respect nothing. POS. Gives good cops a bad name.

IV. New Scholarship Demonstrates That Qualified Immunity is Inconsistent with Section 1983’s Text and Purpose.
