I don't know what happened, but to pull a gun over a fill up shows that he should not have a CCW in the first place.

Agreed. My personal feeling is that one should be passive while carrying. Any altercation could easily lead to a situation where you feel compelled to use deadly force. When tempers flare, rational thought can go out the window. If someone else is an asshat and you walk away, problem solved. Shooting a tire is dumb. Only draw your weapon when you intend to use it. Only pull the trigger when there is no other alternative.

Whatever really happened, he had a responsibility to de-escalate, even if it meant losing face.

A Prosecutor will probably say, "If he was justified in using deadly force, why did he shoot the tire? Obviously he was not in fear for his life."

His duty is to protect and care for his child and his wife. How's he going to do that from a prison cell?
