    If this where one of us it would have said struggle ensued and the homeowners was beaten to death by 3 unknown burgers....

    If someone breaks into your home, and you're there - or you come home and he confronts, rather than flees - to me, that makes it a home invasion, NOT a burglary.

    Sometimes the 5 seconds it takes to back out the front door or 5 seconds it takes to run out the back door might be a better option than 5 years in depositions and court rooms in a civil liability case...I'm just sayin'

    I dealt with a home invasion many years ago. Had I attempted to flee out the front door (bad guy entered through a window on the 2nd floor of a 3-story townhouse,) I would have run straight into the arms of Bad Guy #2 ... presumably waiting for #1 to open the front door and let him in. "Flee" isnt' always the best option. Unfortunately, you can only evaluate the bestness of your choices after the fact.

    I agree, tough call. This homeowner saw the front door damage before he went in. Because he was a cop I guess he figured the first guy thru this door to check things out was going to be a cop, so why not him. I still think it's a slightly different scenario for a civilian who sees the front door damaged or open. Different scenario for someone who believes a family member is supposed to be inside too. Glad you were OK when yours happened.
