But, if you had made it into a pistol before 10-1 and before you put in a Form 1, what happens then ?
I don't know. But maybe MD says you're making and possessing a copycat after 10-1 and therefore prohibited. I don't think they care what it was before 10-1 as long as it was a complete SBR or a pistol.. What they seem to be saying is you're making a copycat after 10-1 and therefore illegal if OAL < 29"

    Only my opinion.

    IANAL.

ETA-As Chad pointed out, this is MD law that the NFA Branch is enforcing, not federal law. They do what MSP tells them to do in this regard.

Started the process on putting together trust documents this morning with the intention of building a SBR. Looks like I picked a poor time to try and get into this.

You can still build an SBR, it just needs to be >29" OAL. (at least for now)

Also a VERY good time, as approvals are taking about 3 weeks, rather than 9 months.

You don't need to have the upper when you get your approval. You can do it later.

Yeah, wish Form 4s were that quick.

I know I don't need it, but I sure as hell want it and that feeling is going to be harder to deal with once I have an approved Form 1 in my hands. Not like you can actually hold a PDF in your hands but you know what I mean. ;)

I'm sure this has been asked already and yes i used the search function. But I have a lower that was transferred as 0 other and i make pistol out out of it and added the sig brace. My upper is 10.5 long. what is the OAL length it needs to be for it be considered a pistol? I am thinking about doing a sbr down the line but i think adding a 6 position collapsible stock with the 10.5 upper it might not be considered a SBR due to the length..

A rifle barrel cannot be less than 16" long w/o the muzzle device attached unless pinned/soldered/welded per atf guidelines.
Once you make it a pistol (only if it was never assembles as a rifle) there are no restrictions on barrel length. You have to use a pistol tube and/or sig brace, any other type of rifle stock makes it an SBR.

A 10.5" barrel with a standard collapsible/telescping stock is about 29.5" long. So you are good to go to make it into an SBR. But, as it has less than a 16" barrel, it cannot be turned into a rifle, just an SBR (with tax stamp)

There are no length requirements for pistols. Except that it has to be over 26" if you want a vertical foregrip. Angled foregrips are OK at any overal length.

If anyone is interested, I FINALLY got my tax stamp yesterday on a Form 1 for a Sig P556. I got the pistol last summer, submitted to MSP in September, got that back in January and sent to BATFE, and got stamp yesterday. So now I can put the pistol upper on a rifle lower (on Sigs, the upper has the serial #, not the lower), and voila.

Oddly, no mention of "2 features". OAL is 30".
