I've been stressing to my reps that it is removing public oversight into a government process that directly impacts citizens. It also saves the state a considerable amount of time and resources by not tying up the courts with appeals to the permit process. Don't let the state forget about the money and resources they stand to save.
Anybody, anybody at all, have the data for the appeals rate from the HPRB to OAH by MSP?
There is an appeal right now to HPRB, then to OAH, and then to Circuit Court, correct? So, how would removing HPRB reduce the number of appeals IF MSP is appealing every adverse HPRB decision to OAH? MSP is tied up at the HPRB level and then at the OAH level, and then possibly again at the Circuit Court level.
Anybody, anybody at all, have the data for the appeals rate from the HPRB to OAH by MSP?
I could be wrong but I believe that, up until recently, they didn't appeal very many of them.
