Problem is that this is the norm. Shouldn't be. Plus, reading the case, I didn't see a red flag about the passenger during the stop. The red flag was reason that the stop was initiated based on a legal stop. Which, the SCOTUS said really doesn't have to be legal anyway. Full Circle.
Officer safety is why the courts have traditionally given a lot of discretion to officers on what constitutes evasive/furtive behavior. When it comes to choosing between risking an officer's life and temporarily inconveniencing a law-abiding citizen, the safety of the officer always wins. In my view if a guy is wearing gang colors and is being evasive when confronted during a traffic stop combined with prior knowledge that the guy is armed, that's enough to justify a search.
