    Tuesday was an emergency "show cause" hearing to determine whether an immediate injunction (prevention of the law taking effect, in this case) was warranted. The judge ruled no, and the law went into effect as the litigation continues.

    October 10th is a scheduling hearing, for procedural purposes only, where all counsel will get together with the judge, compare calendars, and agree on dates for hearings and the like.

    In a nutshell, your interpretation is correct.

    EDIT: Wow, been lurking these forums for so long I didn't realize this was my first post - hi everyone!

    So... did the Scheduling Hearing take place? Does any one know? Bueller....

    To our knowledge, it has not. Since the Government shutdown, the courts have been focused on criminal cases and have left civil issues on the back burner at the district court level. Until they know what their funding and timing is based on the shut down, I personally, do not think we will see anything on a scheduling hearing until the shutdown is resolved.

    Just my .02 worth based on what is known.
