This might be a stupid question, but I keep seeing pre-ban hi-cap mags for sale on gunbroker. Are pre-ban hi-cap mags legal to buy and sell in Md or is 20 rounds the limit no matter how old the mags are? Just wondering why they would even advertise that they were pre-ban unless there was some sort of advantage to them being pre-bans.

Pre-ban is for New York and maybe New Jersey, where it's still illegal to own high capacity magazines made after the AWB was instated.

Guys, NJ has a 15 round limit and CA's law says that the mags had to be in CA at a certain date. You can't buy "pre-ban" mags in those states.

    Pre-bans are basically for NY.

If you have some mags that can be proven to be of a certain age, before Sept 1994, sell them to a person in NY.

looks like NY is one of those jacked up states...that makes 20rds plus illegal then?

In NY, if you have a mag of any capacity that was made before the date the now dead Federal Assault Weapon Ban was enacted, sometime in September 1994, the mag is legal to own/sell/use. Any mag made after that date is illegal unless it it a 10 round or less capacity.

Yes, NY gun laws are WORSE than ours. No suppressors or short barreled rifles, they have a state assault weapon ban that never goes away, no state preemption law, so any town or county can write their own gun laws and in order to buy/own/possess a handgun, you must be issued a pistol permit that can take six or more months to get. Cost is over $100.

Better question is what is legal in Maryland.

You can buy magazine parts kits, but you can't assemble them in state.

You can possess any magazine with any capacity. You have to bring them back with you from out of state.
