    Very interesting. Wonder if it will be held up on appeal. A lot of the story regarding sensitive places laws is still yet to be written.

    No, it was NOT found unconstitutional. It was found likely to wind up that way, at least in key parts, enough for the judge involved to enjoin parts of it pending the actual litigation playing out. And even that, of course, could be appealed by HI, then appealed again, and eventually find itself in SCOTUS possibly years from now.

    It's nice to see that judge recognizing the general state of things, but it's NOT yet a ruling, and it definitely isn't the same as HI having exhausted its appeals options if they get partly or substantially ruled against.

    The real treat, here, is that the judge (and the quite appropriate language she used setting the stage for how the litigation is likely to go) is an Obama appointee. By rough association/disposition, she was as much as the defendants could have hoped for to preserve their counter-Bruen protest law. But it's a testament to Thomas's stellar ruling (which we should all pitch in and have carved into a cliff face somewhere, above a monument to him) that she saw the writing on the wall. So, I'll treat that as a good barometric reading for how this will all eventually play out, our own losing-the-fourth-circuit-judge-lottery not withstanding).

    Of course they’re going to continue to hype that angle, but it’s going to be less of a thing as states (as in Ohio just now) tackle that and women see that Dobbs didn’t ban abortion.
