Yea... that's why I said it's "likely" not his property, not it's "definitely" not his property.

I also realize it’s mostly a semantic argument to begin with. While the local jurisdiction doesn’t technically OWN that portion of your property, they might as well own it as they can do absolutely whatever they want with it. You have the right to pay for it, pay taxes on it, pay to maintain it, but you can’t stop the government from taking some or all of it from you at a whim.
