    I live in Germany right now and my German uncle-in-law is giving me a Mauser C96. Since it is a SBR what do i need to do to own if I come back to MD (or more likely come back to a free state.) I haven't had a chance to look at it yet but presumably it is a German made one from the late 1930s so it should be a C&R right? I'm not into C&R stuff so I need some help on this. My wife really wants it cause if her uncle cant find someone with a German weapons permit (me :)) to take it, he has to destroy it because his permit is expiring, and because of his age and health he is not renewing

    It is C&R if it is made in the 30's. What is the barrel length down to the fraction of an inch??? Is a buttstock accompanying the pistol? Is the buttstock removable or somehow permanently attached (I know it shouldn't be)? Are you in the U.S. military currently stationed in Germany?

    I assume that it is the semi-auto version, with holster stock? If it is a full-auto variation, forget about getting it into the USA. If semi-auto, I would contact ATF to see if is importable into the country. I would not seek legal advise on a forum.

    Yes it has the removable but stock/holster... its definitely not full auto, you can count the number of people allowed full auto in Germany with 2 hands.... my wife is active duty and I work at a military operated gun store/rifle range near Ramstein so I know how to get weapons back in the country (already picked up some nice trinkets :)), I was more concerned with possessing a SBR in MD or any other socialist state... If it is a C&R or the fact that the stock is detachable will that allow an exception to any SBR bans... I still have 2 years left to work it out; I wanted to see if anyone knew off hand or had any usefull info... worst case scenario is I change my address to my uncles house and leave it in Germany, but ultimately i would like to have it with me in the states if possible.

    I purchased a 1930s Broomhandle last year in Maryland. I found it at Gunbroker.com and had it mailed to a dealer. I only filled out the regular pistol paperwork and waited for the State Police to send the "Not Dissaproved" application back to my dealer. As long as no stock is attached, it is a pistol, not a SBR.
    Send the stock back with your personal possesions. Send the pistol with your firearms. By itself, the pistol is just a pistol or I couldn't have just bought it without the Federal Stamp/registration etc.

    sounds like i would have some splaining to do if they found the pistol and stock in my house... I don't mind jumping through hoops or paying taxes if thats what i have to do...

    I thought there were exceptions made for certain Broomhandle mausers and HiPowers that originally came with the detachable stocks to not be classified as SBRs because of their historical nature? Not that you can do it with any old C96 or HiPower, but I guess ones that were originally issued with them.

    The ATF C&R list shows that a semiautomic Broomhandle with original German stock is a C&R not subject to NFA restrictions.
    The fully automatic Schnellfeurer select fire weapon is still subject to NFA restrictions. I provide link to ATF publication.

    Semiauto Broomhandles are not NFA restricted:

    holster/shoulder stocks, all semiautomatic German mfd. variations produced prior to 1940, any caliber.
    Mauser, Pistol-Carbine, model 1896, 7.63mm, with shoulder stock and 11-3/4" to 16" barrel.

    Fully automatc broomhandles are still NFA restricted weapons:
    SECTION IV: National Firearms Act Weapons Classified As Curios Or Relics Under 18 U.S.C. Chapter 44
    The Bureau has determined that the following NFA weapons are curios or relics as defined in 27 CFR 478.11 because of their dates of manufacture. These NFA weapons, classified as curios or relics, are still subject to all the controls under the NFA. However, licensed collectors may acquire, hold, or dispose of them as curios or relics subject to the provisions of 18 U.S.C. Chapter 44 and 27 CFR Part 478. They are still "firearms" as defined in 18 U.S.C. Chapter 44
    and 26 U.S.C. Chapter 53.

    How much will the importer charge to bring it into the US ?
    As far as I know a C&R License will not allow you to import C&R guns from Germany or any other country.

    $95 (you arrange shipping to US) to $145 (TRI arranges shipping to US) for the first gun, $45 for each additional gun. They do all the paperwork for ATF, insure your guns, and either hold it for you or ship to your local FFL.
