I've been out of the country for 6 months can somebody fill me in on SB01?

    I understand an injunction was filed a while back prohibiting SB01 from nullifying our conceal carry permits when it was supposed to go into effect Oct 1st but that's the last I heard. I'm not currently caught up on what's happened in Maryland the last 6 months regarding that.

    Can someone give me some brief cliff notes on any changes? Or is everything still as it was?

    Enforcement of SB 1 Preliminarily Enjoined In Part: On September 29, 2023, a federal district court enjoined enforcement of (1) that part of SB1 that presumptively banned carry by permit holders in privately owned buildings otherwise open to the public (2) that part of SB1 that flatly banned (except by the owner) firearms in locations licensed to serve alcohol for on-site consumption, and (3) that part of existing State law that banned firearms within 1000 feet of a demonstration. The Court's opinion can be found HERE and the Court's order can be found HERE.

    Ok thank you, so no real changes. About the 3 things on hold though, does that mean there are still restrictions on privately owned buildings, establishments with liquor licenses, and 1000 ft of demonstrations?

    What exactly constitutes a demonstration? A protest? Or could it be a street performer and a crowd of 10 people?

    No, it’s as if those portions never passed

    My non Legal opinion is a performer is not a demonstration, as a demonstration has some political aspect to it.

    Err, you cannot open carry anymore. Plus guns are banned in a few new places that weren't enjoined in SB1

    The Original Interpretation ( currently under the Injunction ) = You must be informed by LEO. That an improper demonstration is taking place . and you then have opportunity to move 1,000 feet away .

    Under SB-1 , simply be within 1,000 feet . It doesn't have to visable to you , or you even know it's there .

    Are you a member of Maryland Shall Issue? MSRPA? If so, thank you (you are a PLAINTIFF)

    2) NO
    3) NO.

    4) It DOESN'T MATTER. Enjoined means -
    LAW (ENJOIN SOMEONE FROM)
    prohibit someone from performing (a particular action) by issuing an injunction:
    "he was enjoined from using the patent"
