    "I do solemnly swear (affirm) that I will support the
    Constitution of the United States, and the Constitution of
    the State of Illinois, and that I will faithfully discharge
    the duties of the office of .... to the best of my ability."

    This is the oath of office prescribed to be sworn by all public officers in the State of Illinois. It would appear that the legislators voting for that bill, and Governor Pritzker, who signed it into [unconstitutional] law have violated their oaths of office as a collective and as individuals.

    They did this knowingly.

    This isn't a morally-informed act of civil disobedience, subject to penalty. It is an act in defiance of law done for personal political gain.

    Appeals court upholds Illinois assault weapons ban

    Bill Clitoon judge.

    The 7th Circuit Court of Appeals on Friday upheld Illinois' ban on assault weapons, marking the latest win for the state's law as it faces a litany of legal challenges.

    The state Supreme Court previously upheld the law while the U.S. Supreme Court in May declined to take up the case on procedural grounds.
    Friday's ruling could see the case return to the top bench.

    The Protect Illinois Communities Act bars the sale of certain semi-automatic "assault weapons." Democratic Gov. J.B. Pritzker signed the measure earlier this year.

    "Government may punish a deliberately false fire alarm; it may condition free assembly on the issuance of a permit; it may require voters to present a valid identification card; and it may punish child abuse even if it is done in the name of religion. The right enshrined in the Second Amendment is no different," wrote Judge Diane Wood in upholding the ban, according to The Hill.

    Pritzker celebrated the ruling, saying "[t]he 7th Circuit Court of Appeals has affirmed what gun safety advocates have said from day one—the Protect Illinois Communities Act is a commonsense law that will keep Illinoisians safe."

    The ban will likely next return to the Supreme Court, where a conservative majority last year handed down a significant Second Amendment ruling last year by ruling unconstitutional a New York provision requiring that concealed carry permit applicants demonstrate a need to carry a firearm.

    Is she vacating an injunction pending the outcome of something already in the works, or an injunction as a done deal against the law? Meaning, are we waiting now for an existing case to play out, or does this now call for a fresh new hell of litigation farther up the food chain?

    The judge upheld the IL ban on "assault weapons."

    They really did ban almost everything. Hell, they even classify a semiautomatic pistol with a threaded barrel as an assault weapon.

    An "assault weapon" is defined in the new law as the following:

    A semiautomatic rifle that has the capacity to accept a detachable magazine or that may be readily modified to accept a detachable magazine, if the firearm has one or more of the following:
    a pistol grip or thumbhole stock;
    any feature capable of functioning as a protruding grip that can be held by the non-trigger hand;
    a folding, telescoping, thumbhole, or detachable stock, or a stock that is otherwise foldable or adjustable in a manner that operates to reduce the length, size, or any other dimension, or otherwise enhances the concealability of, the weapon;
    a flash suppressor;
    a grenade launcher;
    a shroud attached to the barrel or that partially or completely encircles the barrel, allowing the bearer to hold the firearm with the non-trigger hand without being burned, but excluding a slide that encloses the barrel.

    A semiautomatic rifle that has a fixed magazine with the capacity to accept more than 10 rounds, except for an attached tubular device designed to accept, and capable of operating only with, .22 caliber rimfire ammunition.

    A semiautomatic pistol that has the capacity to accept a detachable magazine or that may be readily modified to accept a detachable magazine, if the firearm has one or more of the following:
    a threaded barrel;
    a second pistol grip or another feature capable of functioning as a protruding grip that can be held by the non-trigger hand;
    a shroud attached to the barrel or that partially or completely encircles the barrel, allowing the bearer to hold the firearm with the non-trigger hand without being burned, but excluding a slide that encloses the barrel;
    a flash suppressor;
    the capacity to accept a detachable magazine at some location outside of the pistol grip; or
    a buffer tube, arm brace, or other part that protrudes horizontally behind the pistol grip and is designed or redesigned to allow or facilitate a firearm to be fired from the shoulder.

    A semiautomatic pistol that has a fixed magazine with the capacity to accept more than 15 rounds.

    Any shotgun with a revolving cylinder.
    A semiautomatic shotgun that has one or more of the following:
    a pistol grip or thumbhole stock;
    any feature capable of functioning as a protruding grip that can be held by the non-trigger hand;
    a folding or thumbhole stock;
    a grenade launcher;
    a fixed magazine with the capacity of more than 5 rounds; or
    the capacity to accept a detachable magazine.

    Any semiautomatic firearm that has the capacity to accept a belt ammunition feeding device.

    Any firearm that has been modified to be operable as an assault weapon as defined in this Section.

    Any part or combination of parts designed or intended to convert a firearm into an assault weapon, including any combination of parts from which an assault weapon may be readily assembled if those parts are in the possession or under the control of the same person.

    Looks to be all about the injunction, so I doubt this portion gets en banc or SCOTUS.

    Once we get to the merits it may turn out differently but if it goes to the same panel we'll be SOL, unless SCOTUS takes up a different case in the interim.
