    If I were them I wouldn't want to delay while there's still only 8 justices.
    They also are due for their reply in Nichols on the 17th. Since that case is in CA9, they will attempt and be granted more extensions since they already got away with it once by asking for an extension the day before it's due.

    Agreed that it wouldn't be smart to request an extension, but one can always hope.... :)

    Two wildly different styles of brief there. Texas is well-reasoned and concisely fact-filled; GOA is rather in-your-face aggressive, and takes petitioners to task for giving away most of the cake in order to get a taste of the core crumbs.

    Both pretty enjoyable but I find the Texas brief more compelling. We'll all grow old waiting to see what comes of all this.
