Is the template Maryland Shooter links to still good?

    http://marylandshooter.com/ar15/trust/trust.asp

At this time I would only have one item listed (and that would be upon approval).

I just take the trust document to the bank, have 2 or 3 notarized and send one in with my form 4?

Any need to have a bank account in the trusts name and pay out of that account?

3 NFA items later, IMO it is good because it works for me and at least 30 other people.

Notarize the original - send copies to ATF, save money, enjoy life.

    OR

    Pay an attorney.

    No matter to me

When I submit my original trust with my Form1 or Form 4 do I need to include a Schecduke A or send that in after I get the stamps or both?

    Goodbye MD, Hello freedom
Cool, and I should include the new NFA item on that Schedule A or wait until the Stamp comes back then send the modified Schedule A in then?

That depends...if its a F1, include it on the schedule A when you send it in. If filing a F1, you already have possession of the firearm and the trust can own it. If you have a F4, I have heard of guys doing both ways and still getting approved. I, personally, don't amend the schedule A until after the F4 is approved and I take possession of the weapon. The theory behind that is that you do not actually own the weapon yet when filing a F4. You don't have to worry about sending anything back to the ATF afterwards however. Just write or type in the necessary info and go get your barrel hot. (not a sexual reference )

This reminds of the mis-information/he said, she said I got when I asked about whether I had to go thru MSP or if I could have a local CLEO sign my form 4. I got a bunch of, "you MUST do it this way or that way", with NO accompanied experience.
I personally like the whole "I have personally done it this way, and it works" information.
I also agree with the, "This is the way everyone else does it, so it MUST be the ONLY way to do it" approach:sarcasm:

Thanks for stating the FACTS MD Shooter! I have a friend who has worked for a law firm for YRS filing paperwork and such and has stated that a Trust is a NO BRAINER and he used to do them extensively. I need to sit down with him and try to weed out the details or see if he knows any attornies that are pro-gun that may be willing to make some cash by doing these cheaper.

    A few quick questions...

-I did the trust route a few years back. Haven't bought since. My quicken willmaker prints out the trust with a "DUPLICATE" watermark on it. Is that OK?

-I need to send the entire schedule A, and get everything notarized again?

-Last time I sent a check from my personal bank account. Everything came back fine. Has it been settled yet as to whether or not this is OK?

-Send the ATF two copies of everything, trust included, or just the forms?

You really should consult an Attorney. You have dabbled in something you really dont understand and it can cost you BIG TIME.

Your Copies need to have legible Notary Comission/Seals. It should be notarized already, not each time you buy an NFA Item. If you dont have a hard copy then what are you going to show BATFE with your Stamp if requested. What do you have for your permanent records showing Assets of the Trust?

You should not pay for a NFA Item or the Tax with your checking account. Use a Money Order or create a "Trust" Account at your Credit Union.

You only need ONE copy of the Trust (Not the Declaration of Trust) with the NFA Application. You send TWO copies of the Form 1 or 4 (Depending on the type of firearm/item), and a COPY of your Assignment/Schedule A

This advice above is what I paid my attorney for.

All my trust records are on the computer, and backed up on two thumb drives. It's all covered there. I just don't have the original with the notary on it. I am pretty sure last time I just got it notarized again and it was fine (I bought one NFA item, then two more a few months later).

I have already bought three NFA items so I am not really worried about the ATF knocking down my door. If there is one thing I have learned it's that if the government wants to get you, they will. No amount of paperwork in the world will have you covered. All I do is try to keep my nose clean and stay out of their cross hairs. I know some people will think that is a bad attitude, but I have seen the government take down a lot of businesses/people in my time. They all had lawyers, accountants, etc. Didn't mean a hill of beans.

Thanks for the answers though, I will let you guys know how everything turns out.

    on the amendments/itemization page, there's a line: Executed at ____|____|____, on __/__/____.

The date of signing is clear, but "executed at" is what, the location? This should match the original address?

    Thanks.

I'll wait for someone else to chime in, but I don't believe you send in that sheet just an updated schedule A. I believe that page is for your own use.
