If I buy a “pre” 2013 lower, can it be built into pre-ban configuration?

If they are paired with the original upper they most certainly can be inherited, and then used, upgraded as a pre-2013 model.
But you are correct, as a lower only, once it changes hands, it becomes a post-2013 item, and all State Statutes apply.
