    What is the purpose of having the 77R form questions? If they already are going to run a background check and find all the information anyways, why even ask?

    Is it possible to answer some of the criminal questions with a "yes" and still get not disapproved? Or is the only reason to answer "yes" would be if you had a disqualifing crime?

    It also informs people that may not be able to legally buy a firearm that they cannot legally go forward. On 77r1, people may read the question about being in a mental hospital for over 30 days, or being a habitual drunkard, and the read how these are disqualifying factors in the red down below. It allows them an opportunity to stop attempting to buy a gun before it becomes a big legal no-no.

    I was under the impression that the FFL retained the 4473 and it's NOT sent to BATFE (unless the FFL goes out of business) but can be inspected upon demand.

    That is correct. The 4473 stays with the business until you surrender or they take your FFL. Then you send them to West Virginia. (at least that is where I sent mine when I shut down)

    I can see the purpose of having the personal details: name, address, SSN, etc. but the questions I don't understand.

    Maybe to allow people to understand if they are allowed to buy this type of gun or not. Why can't the FFL just ask these questions before they buy the gun and solve that problem.

    I feel like this is another way they are trying to disapprove people. Why can't we just fill out our info, and send it in? if we are disapproved then we get a disapproved back, rather than a disapproved and other problems.

    Because if your truthful with the questions and are disqualified it allows the FFL to not continue with the sale instead of tying up the system for checks that they already know wont pass.

    It saves the FFL time, the people doing the checks times, and leaves more firearms on the floor for legal buyers.

    It also allows the state to charge you for lying on their forms.

    There are differences in wording between 4473s and 77R . One could concievably pass on a 4473 , and be disaproved on a 77R. And it gives Md the possability to charge Perjury under state statutes.

    The other reason is it gives them the option of bringing more charges against you for providing false information. Another supposed deterrent I guess.

    Get it in writing, then you can prosecute the ones who lie.

    You mean the big deal no-no that never gets prosecuted, let alone charged?

    God how I would dearly love for them to just enforce what laws we already have...
