Does a background check have to list a firearm and serial number (for the national registry, I love hearing people say there is not one) or can he cut that part out?
The background check request does not include this data and successful backround check data is quickly purged.
However, in order to access the existing NICS system you have to be an FFL.
That means that while the firearm specifics are not part of the background check, they ARE recorded on the 4473 and in the FFL's acquisition and disposition records that must be kept for 20 years or turned over to the ATFE when the dealer goes out of business.
If you look at the House legislation it is very simple. It simply amends the law to prohibit any firearms transfers by non-licensees. It doesn't mention background checks but creates a system where you are required to use an FFL for a transfer. FFL's must conduct background checks.
It really looks like both sides are trying to tank this (all or nothing, etc.) rather than produce anything that will get enacted into law. They want this as an issue. If they get something passed, it goes away.
