Maryland law states 7 day waiting period. When we were doing paper forms, the whole Sunday or holiday thing could not really be enforced. With the portal, it can be enforced and it is. If your 7th falls on a Sunday, that does not count as being the 7th day. If your 7th day falls on a holiday, then that doesn’t count as your 7th day.
Example: the dealer submits the serial number on the Monday before Memorial Day or Labor Day. Your 7th day would be the Sunday before those holidays- does not count. The holiday would now be your 7th day - does not count. Tuesday is now your 7th day, so Wednesday is your 8th day - or day of transfer.
As far as “not disapproved” goes, MD says “if the application is not disapproved by the MSP, the applicant may retrieve the handgun on the 8th day.” “Not disapproved” comes from the law as written, not a liability issue as so many tend to believe. The licensing division of MSP is not trying to keep you from getting handguns. They enforce the laws as interpreted by the attorney general - currently Brian Frosh. When he “interprets” a law incorrectly, MSP enforces the law incorrectly. I’m sure loads of people will hammer me for that comment, but sometimes the truth is not “everybody is out to take away my rights”.
Totally agree with you. Even the tools at the LD know what they are doing is garbage but they are automatons and will do whatever Frosh, or his right hand Bowen, tell them to do.
