Question about Bushmaster receiver, and pistol caliber carbine

    Two separate questions.

    I've decided to buy a dedicated lower receiver for that old Bushmaster A3 20" HBAR I've had for years. I'm going to use its lower receiver with as many evil pencil-barreled uppers I can get my hands on, just for the heck of it. :beer:

    Question 1. Were the Bushmaster "XM15" receivers banned, following the Beltway Idiots thing a few years back? I remember hearing, or reading, of such stupidity, but don't know whether the enlightened Maryland lawmakers followed through with it.

    I realize any decent brand AR receiver will work, but if I can get one that looked like the original, then why not.

    Secondly, I'm thinking of buying a pistol caliber "AR-15" carbine that takes Glock mags, and possibly a 7.62X51 rifle version as well.

    Question 2. Both types are still legal in MD, right?

    The firearm that is banned is the Gwynn Firearms Bushmaster, not the manufacturer known as Bushmaster Firearms International. With that said, MSP is taking the view that if it is a firearm that says Bushmaster on it, it is banned by name under FSA2013, which is incorrect.

    You will not find a FFL in MD that will sell you a stripped lower or an HBAR that is made by Bushmaster Firearms International.

    Pistol caliber carbines are legal in MD, as are AR10's and clones.

    The MSP Firearms Division is really amazing. Up until last year, they used to list Importers as manufacturers and get half the model designations on the Handgun Roster wrong (I'll eventually post another thread about the idiocy), and now they ban, or not approve, something based on a name, regardless of the characteristics. There's a prime example of a government entity given too much power, and not using it properly!

    Guess I'll have to use another receiver.

    To be fair, the power you speak of resides with the AG's office that instructs the MSP on what is legal and what is not, for them to do.

    True, Lawmakers and the Attorney General define the laws and how to enforce them. The State Police just manages to screw up handgun model designations and manufacturers, even though they're clearly written on the paperwork submitted by us, the people seeking approval to buy said guns. I believe in some cases, one has to send in their gun, so they should have the stamped writing on the steel right there in front of them. With neither model, nor manufacturer correct on the Roster, how are we supposed to be able to buy them?

    To make matters worse, just this year, I noticed they simply deleted from the list all Jericho pistols previously under "manufacturer" Magnum Research, so that no Jerichos built before IMI's name change to IWI, my apologies for the acronyms, meaning the many, many Jerichos in circulation, are approved.

    I've saved info. on some other very basic mistakes in the Roster, mistakes I found while searching for a gun prior to ordering it. In most cases, since I assume it's a bureaucratic hassle to get them approved, I simply bought something else, but when I pay into a system, I believe it should work!

    On the other hand, all those old cash-and-carry Bushmasters are now grandfathered, and it should be legal to rebuild them in non-HBAR configurations.

    I assume they're wrongly banning new Bushmasters, so as to not have to look up a serial number or read the side of the receiver to see which state it was built in, Maine or New York.

    We have to follow the rules they make up, so why is it they don't do what it is they're supposed to? We pay for all their salaries. If it weren't a government job, those making the mistakes would be on the streets. Unless, of course, the mistakes were made on purpose, to limit the sales, or transfers, of handguns.

    I've handled the weird one, second from the top, but didn't care for it. I like the bottom two, though!

    They probably tried to ban as much as they could get away with, and the only thing that stuck to the wall was the name Bushmaster, even though they made many different products. Since then, the company has changed hands, locations, and product line, but whoever is calling the shots for the State has decided to extend his reach a little.

    That rifle sure looks nice!

    The Maryland State Police have always understood what "Bushmaster" meant, that it refered to the odd AR/AK bastard hybrid oddities and had nothing to do with the later AR15s made by a manufacturer named "Bushmaster Arms". That's why the HBAR AR15s made by Bushmaster Arms were never considered "regulated" rifles and were always sold cash and carry on a 4473.

    Since 2013, someone :"got to" the MSP and persuaded them to adopt a deliberate "misunderstanding" of the name "Bushmaster" on the old list.

    That creates an odd situation: AR15s and AKs, etc, sold as "Regulated" before 2013 are now grandfathered. Colt Sporter HBARs, Rock River HBARs, etc. don't need to be grandfathered, because they were never regulated in the first place. They've always been cash and carry, and still are. But Bushmaster HBARs are now being treated as grandfathered banned rifles, and presumably can't be sold in state, even though they were never "regulated" before 10/1/13.

    It's a travesty and a mockery of the Rule of Law. We're living in a dictatorship.

    I fully understand what you were trying to say now, and agree that there likely were violations of due process of law.

    Then file a lawsuit over this.

    It seems Bushmaster did not care enough to do so, so screw them.

    And yes, IIRC, they were contacted and decided MD market was not worth it to them.

    They were, by MSI, and they were not interested in filing a lawsuit.
