    That's the letter of the law, but there's no prescribed penalty if they don't follow it.

    I'm interested to see this in writing somewhere that you need the card. I have seen an almost 50/50 split of people saying you do or don't need it in hand and only need a number. I certainly don't want to get in trouble but does it even fall on me if the FFL is ok with just having the active number? Where can I read the law?

    You see all kinds of crap posted, what matters is what the FFL actually requires.

    I don't think its in the law, but its in the "policy updates" that MSP gives FFL's. FFL's get orders from MSP that they have to follow to keep their MD licenses and fear of revocation works. It falls on the FFL, not you.

    Any dealer not demanding to see the card in person is risking their license. You will continue to hear that you don't actually need the card, I guarantee it.

    Prior to 2013 you didn't need to have your MSP safety class card as long as you could put the number on the form.

    This changed with the HQL.

    I bet the majority of misinformation comes from that old policy.

    So it isn't actually a law just a MSP policy? How can a police force charged with enforcing the laws on the books basically create a law of their own and call it a policy? I just don't understand how our state police operates this way... it seems like over reach to me. If it's a written law passed by the state and signed by the governor we have to live by it. If not, how is it even enforceable.

    There is no live fire requirement in the act passed by the MD GA either ...

    Thje MSP web sitesays the card must be POSSESSED when the firearm is purchased. Most FFL's aren't going to jeopardize their license by going agaisnt MSP. The statute basically says the same thing.

    It means if you don't have the card in your possession, the FFL is not suppos3ed to transfer the firearm

    in my not so legal opinion.

    Does the card itself count as the license though? I would have to assume no it does not and the license number is the license. This is very unclear IMO.

    if a cop stops you for driving w/o a license, you do have a license, but you don't possess it.

    you might get a ticket.

    This is actually a good analogy. You don't get a ticket for driving without a license but a ticket for failure to display a license.
