    There is no NICS for individual to individual transfers. I'm buying one right now with a trust from an individual in state. All I'm going to fill out is the Form 4. And I still don't believe the ATF can legally make dealers run NICS. Illegally they can and have.

    No different that other face to face transfers.

    Yes, they do make dealers run NICS check.

    Sure it's different than an instate NFA individual transfer. When non trusts do an instate purchase, the Form 4 is a background check on the buyer. There is no background check done for the instate Form 4 for a trust though.

    And it doesn't make it legal. MSP was demanding dealers wait till paperwork comes back. That's not the law says. MSP says you can't buy Bushmaster AR-15s. The law clearly doesn't say that, but FFLs are complying because it's not worth it to them.

    It will be interesting if the BATFE enacts this as published, as there has been no funding for the additional costs for them.

    This is a good point. I don't enough about how the gov agencies work, but I'm afraid that without additional funding they will just stretch out the background checks even longer. NFA wait times did almost hit a year at one point.

    I am wondering the dragging of feet is due to lack of funding.

    Also, when they publish the final rule, they have to address ALL comments made. It might be that the comments are not in favor (ya think?) of anything like this.
