    Next week Judge Legg has no schedule, just like last week. One would hope today is the day otherwise it looks to me that it could be an additional week. But then again. We want the right decision, not a hurried one.

    Then again, it keeps my PACER account in the free zone for this 1/4.

    Hmmm, how does one make illegally carrying a firearm any more illegal.
    You can increase the penalties, but it is illegal, or it is not.

    Well in reality the harder the punishment the more it would discourage someone from doing it.

    The problem is, no criminal is going to check the books and see what would happen if they get caught or whatever. They will just brake the law no matter the consequence.

    1/2? How about 0-2. Obamacare was upheld (but called a tax), and Stolen Valor was ruled to be unconstitutional. That's 0-2.

    I hate to be off topic but maybe escapellate can chime in.

    Since it was rule that it has to be a tax. Does it have to go back to congress and get a 2/3rds majority vote now?

    Just because he doesn't have any hearings scheduled doesn't mean he isn't in the office working on other things. (Like the stay)

    I would agree, however the calender indicates "No Proceedings" when a judge is not hearing cases. This calender doesn't have his name on the schedule.
    We can only hope! Then again who knows.

    Judge Legg has moved to Senor status. That means he's out of rotation unless he feels like it. He makes his own schedule and pretty much stands in when he feels like it. Nice job if you can get it.

    In lieu of retirement, the system is trying to get judges to go into senior status. The whole system (everywhere) is seriously overtaxed. Senior judges might not sit standard calendars, but they still work. In the last year we've seen Chief Justice Roberts ask Senior judges to take on cases in multiple circuits that are not their own. He's using them like a "ready reserve".

    We need more judges, but won't get them until the knuckleheads in Congress get their act together. Until then, the courts will use every trick they got, including Senior judgeship.

    No one was being singled out, and the feelings are understood.

    No harm done, and (for me) I'd rather see mildly impatient interested people willing to make a difference, than mere hangers-on who don't have a dog in the fight.

    Nope. The law stands, except for that part the Court did strike down (loss of all Medicaid money as a penalty on those states that would not agree to the super expensive expansion of Medicaid). That just means that HHS can't inflict that penalty on the states.

    I think he is vacationing up on the Maine coast, eating lobster, hiking in Acadia, escaping this God Awful heat, and enjoying his senior status. (sorry, that's what *I* would be doing....:D)

    He is in Portland, we just saw a video of him O/Cing a gun and standing up for his rights.

    What is the likelihood that judge Legg has planned all along to let this stay ride all of the way through the outcome of the appeal in the 4th?

    Did he ever say that he would make a change in the stay one way or the other after all of the briefs were in, or is this something we just wanted to assume?

    One of the ways to keep this in perspective is to look back to early March. Did any of us dare to imagine where we are today?

    I was as surprised as Dougie Gansler and the state of MD. They never thought this could happen. I didn't think I'd live to see where we are right now

    But as I've gotten older, I have learned to be more patient.

    That's true. However there are attorneys all over the world that thought the SCOTUS would never support Obama care, but now look where we are. Talk about unconstitutional rulings. It seem that all to many judges think the constitution is only a list of suggestions.
