Criminal Law - First-Degree Assault - Assault With a Firearm

Adding a certain intent requirement to the elements of the crime of first degree assault, with regard to committing an assault with a firearm.

In theory, if applied properly, it would actually "go easier" on gun owners. Because then people who feel scared by a gun, couldn't have someone charged by simply having or holding a firearm.

"I felt scared for my life because I saw they had a gun".

I’m intentionally assaulting my attacker so am I a defender or assaulting?
