Can I buy a stripped lower in MD?

    You can buy an 80% lower and finish it to make either a PISTOL or an HBAR rifle. You cannot make an M4 or M4A1 clone ie lightweight 16" inch carbine. The barrel MUST BE A HEAVY BARREL.

    Any configuration other than a PISTOL or HEAVY BARRELED RIFLE (or carbine) is ILLEGAL!

    If you are a Maryland resident, not only can you not buy an AR-15 lower in Maryland, it is illegal to purchase one anywhere in the country. The only exception is having it shipped to an 07 FFL and have him put an HBAR upper on it, do a nics check and log it out to you. Easier just to purchase an HBAR and treat like any other rifle.

    I was told that building an AR pistol from an 80% lower that was completed after Oct 1st is illegal. I hope that I was misinformed.

    Grey area really especially since an 80% does not need to beregistered the state would have to prove you bought post 10/1 and made into an illegal firearm. IF you paid cash at a gunshow or 3rd party they really would be hard pressed to prove it.

    I'm fairly certain finishing an 80% lower in MD post 10/1/13 is illegal. If your logic were correct, couldn't you buy a regular virgin stripped lower and build an HBAR or Pistol?

    Yes. MSP is operating under the (I believe mistaken) interpretation that a stripped AR15 lower is itself an Assault Long Gun. Possession of a finished stripped lower in MD would be just as illegal under that interpretation as getting an AR lower transferred to you in MD.

    Is it illegal? Maybe. Is it possible to beat in court? Maybe. I wouldn't want to do it.

    Now, the question is, can you finish an 80% lower outside of the state, assemble it into a legal configuration, (ie. HBAR rifle), and bring it back? You are not transporting an assault weapon into the state, correct?

    Some folks hate on vendors for not wanting to ship lower parts kits here, when even we have disagreements over what the law means. And of course, the MSP seems to be confused about what the law says.

    Some possibilities -

    1) People are lazy. It's easier to just ask than to do a little research.
    2) People seek instant gratification. Research takes time.
    3) People feel entitled to an answer.
    4) Research resulted in an unsatisfactory answer, so the question will be repeated until a satisfactory response is received.
    5) Some people are computer-illiterate, and searching a forum for answers to a previously asked question might as well be rocket surgery.
    6) The opposing team is trolling for usable ammunition against us.

    7) Using to broad of a term overloads the search engine and provides no results.
    8) Sometimes the answer is in the Water Cooler and the questioner has less than 50 posts.

    I'm glad to see some don't take them selves to seriously. These are all great answers. My favorite is number 6.

    YOU CANNOT buy a stripped lower of ANY kind (AR15, AR10, etc.). You have to by an HBAR COMPLETE rifle from a Marlyand FFL (thats right, a complete rifle, barrel, upper, BCG, etc). You may customize the rifle as you wish as long as the barrel remains a HBAR (no lightweight barrels, or m4 barrels).
