    Say I wanted to sell a firearm that is now banned to purchase but not own in MD. Am i allowed to sell it to an out of state gun store or private party or has MD restricted residents from selling now to ?

    You can sell it to any ffl, in or out of state. Or you can consign it through an ffl for sale to someone out of state.

    So ffl's can still have ak's and pre ban AR's as long as they sell them to out of state residents

    Here is the Rub...

    Say you take your rifle to a gun store in Pa & put it on consignment...

    And 6 months later it hasn't sold & you decide you want it back...

    At that point the gun belongs (FFL paperwork wise) to the gun store in Pa...

    So then it needs to be shipped to your FFL in Merry-Land...

    Where it is impossible for them to re-assign it back to you because it's after 10/1/2013...

    So once you put it up for adoption you can't get it back...

    This is true about consignment in fact, it'd be the same if you were consigning through a MD ffl. Still need to do paperwork to get it back. So you might get less money, but selling it outright to the ffl may be the best route.

    You should will all of your now-banned firearms to those who were too young to purchase their own on October 1, 2013. That is one way to legally transfer banned arms after 10/1/13. Keep those arms in Maryland!

    I have consigned a couple of guns. Thought better of it and walked out just signing a form saying I had taken it back.

    My bad. I havent done it personally, but I have a friend who had to do paperwork to get his consignment gun back. Also, seen someone have to so paperwork to get their gun back after getting gunsmith work done. That situation was a total cluster by the ffl though...

    In the case of an AR... You can sell(transfer) the lower, but then it can only be re-configured as a pistol or be fitted with an HBAR upper afterward. Then sell the pre-ban upper... I know... Pain in the ass...:sad20:

    Can you also sell it on Gunbroker, etc. To an out of state buyer provided you ship only to his out of state FFL?

    An In-State FFL is NOT prohibited from having these in their stock... They are prohibited to whom they sell... LEO's can still purchase Pre-Ban ARs in Maryland.

    ... just not the peasants...:rolleyes:

    § 4-303. Assault weapons -- Prohibited

    (a) In general. -- Except as provided in subsection (b) of this section, a person may not:

    (1) transport an assault weapon into the State; or

    (2) possess, sell, offer to sell, transfer, purchase, or receive an assault weapon.

    (b) Exception. --

    (1) A person who lawfully possessed an assault pistol before June 1, 1994, and who registered the assault pistol with the Secretary of State Police before August 1, 1994, may:

    (i) continue to possess and transport the assault pistol; or

    (ii) while carrying a court order requiring the surrender of the assault pistol, transport the assault pistol directly to the law enforcement unit, barracks, or station if the person has notified the law enforcement unit, barracks, or station that the person is transporting the assault pistol in accordance with a court order and the assault pistol is unloaded.

    (2) A licensed firearms dealer may continue to possess, sell, offer for sale, or transfer an assault long gun or a copycat weapon that the licensed firearms dealer lawfully possessed on or before October 1, 2013.
