    I am unclear whether its 3 or 2. It is 2 I think, because the original 6 included D.C. which was de facto shall issue.


    Meanwhile, only six States and the District of Columbia have "may issue" licensing laws, under which authorities have discretion to deny concealed-carry licenses even when the applicant satisfies the statutory criteria, usually because the applicant has not demonstrated cause or suitability for the relevant license. Aside from New York, then, only California, the District of Columbia, Hawaii, Maryland, Massachusetts, and New Jersey have analogues to the "proper cause" standard.


    So I think that we are down to HI and MD.

    Although technically I do not consider NYs new scheme that they passed with 4 references, a social media proctology exam, and demanding the names of everyone living with you shall issue consistent with a constitutional right.

    I think we need to look at NY/MD/NJ trying all of this fuckery as a positive thing…they are playing defense because since about 2004, this country has really expanded gun rights.

    Half the country is Constitutional Carry with more states already in line. No Federal AWB and there never will be unless major fuckery is afoot.

    These very few Leftist states are on the defensive, this is a good thing

    Well, after 90 days, I imagine there will be a metric s-ton of appeals at the Office of Administrative Hearings…..if there are 2,000 cases that have strict timeframes, sounds like they’ll have to ramp up too.

    Also, the MGA will have to have some good reasoning as to why they are increasing CCW requirements since the THT standard would fail those requirements.

    If Frosh, Hogan, and the MSP keep delaying, I imagine there will be a lot of lawsuits and 1983 actions. Imagine facing the ass end of 2,000 separate 1983 lawsuits at the same time.
    The obvious solution to break the logjam would be a circuit court judge declare 5-306 & 4-203 unconstitutional and strike the laws.

    4-203 relies of 5-306 to determine criminal penalties.

    I was just thinking and I hope it does NOT come to this and I am NOT advocating for this.

    There’s a doctrine that you have the ability to resist an unlawful arrest. If an officer tries to arrest someone for concealed carry, the “suspect” would be able to resist the arrest lawfully. If the officer escalates to the use of a firearm, I believe it would then be murder of the “suspect.” With the line against the police these days, seems like a road I wouldn’t want to travel down if I was a cop.

    Again, not advocating anything and not suggesting anyone do anything. Just thinking out loud.
    Dead due to error in judgement on either side is still no less DEAD.

    Do NOT place yourself (in the general sense) into the position where there is any question in the matter.

    Never interfere with your adversary when they are self-destructing. NY's actions, which are contempt both of and for court, may poison the judicial well for the remainder of the holdout states that were hoping to keep some "reasonable" restrictions and permitting standards.

    Thomas anticipated some pushback, but I doubt he expected a Governor to say to the TV cameras that she was doubling down on outright defiance of a very specific directive from the Supreme Court to her state. And that may annoy and even scare center-left judges who may have previously entertained ideas of creative interpretations of Bruen in favor of maintaining some state restrictions.
