    I'm not up on the details of the new draconian DE gun laws. As a MD resident will I be able to bring a semi-auto firearm to a range in DE? Is there an exception for semi-auto rimfires (22LR)? Thank you.

    Good question but I would advise all MD residents to only use ranges in PA, WV, and VA.

    God knows what records Maryland makes their ranges keep on people.

    This is a critical issue as many shooters from states other than DE compete at Delaware ranges in shooting disciplines that use semi-auto weapons. I compete with a semi in a 22LR discipline, and have also just become a member at the Bridgeville Rifle & Pistol Club.

    If HB 450 gets signed into law, it will be illegal to transport "assault weapons" in Delaware.

    What is their definition of an assault weapon? Any weapon used to assault someone else? If I use a pencil to stab someone in the neck I just converted a writing implement into an implement of murder, or an "assault weapon". Freaking libs.

    Okay . . .

    I am NOT a lawyer, but I’ve spent a few minutes reviewing HB 450 with amendment1. My non-expert opinion is:

    1) I think that it is OK to transport a centerfire “assault” weapon in DE between the owner’s residence and a proper “gun range”, IF the weapon was legally acquired prior to the signing of the bill (today June 30, 2022). No mention is made of any differentiation between DE residents and out-of-state gun owners. (Refer to Section (3) a,b, and d, Lines 217 to 227)

    2) The bill refers to an assault rifle as “A semiautomatic, centerfire rifle that has a detachable magazine” (Lines 126-134, but there are additional specs). This appears to specifically EXCLUDE semi-automatic RIMFIRE rifles (like my competition 10/22)

    3) The bill does not include the word “centerfire” in the description of regulated pistols (therefore rimfire pistols INCLUDED), but also includes one of: a magazine outside of the pistol grip; or a threaded barrel; or a barrel “shroud”. (NOTE: As my wife’s little P22 22LR pistol has a threaded barrel, it is apparently an assault weapon.)

    PLEASE, do not take the above as any kind of formal expert review or opinion. I ask that anyone with a better basis in legalese, gun legislation and a familiarity with HB450 to provide a more informed opinion.

    Delaware uses the Maryland banned list for assault long gun.

    An assault weapon is an assault long gun, and assault pistol, or a copycat weapon.

    Using the Connecticut standard, copycat weapon means the a semi-automatic centerfire rifle that can accept a detachable magazine and has at least one of the following.

    A folding or telescoping stock. Any grip of the weapon including a pistol grip thumbhole stock or other stock the use of which would allow the individual to grip the weapon resulting in any finger on the trigger hand in addition to the trigger finger being directly below any portion of the action of the weapon when firing. A forward pistol grip. A flash suppressor. A grenade launcher or flare launcher. A semi-automatic center fire rifle that has an overall length of less than 30 in.

    An assault pistol is a semi-automatic pistol that can accept a detachable magazine and has at least one of the following. An ability to accept a detachable ammunition magazine that attaches at some location outside of the pistol grip. A threaded barrel capable of accepting a flash suppressor, forward pistol grip, or silencer. A shroud that is attached to or partially or completely encircles the barrel that permits the shooter to fire the firearm without being burned except a slide that encloses the barrel. A second hand grip.

    A semi-automatic shotgun that has both of the following. A folding a telescoping stock. Any grip of the weapon including a pistol grip, a thumb hole stock, or any other stock, the use of which would allow an individual to grip the weapon, resulting in any finger on the trigger hand in addition to the trigger finger being directly below any portion of the action of the weapon when firing. A semi-automatic shotgun that has the ability to accept the detachable magazine. A shotgun with a revolving cylinder.

    A semi-automatic pistol with a fixed magazine that can accept more than 17 rounds.

    A semi automatic centerfire rifle that has a fixed magazine that can accept more than 17 rounds.

    Gun owners who hold a Delaware certificate of possession are able to transport an assault weapon only between the places specified in the law.

    It will be illegal to transport an assault weapon into the state. Page 6, line 167.

    Where in HB450 does it say it is illegal to transport these if you acquired the weapon prior to today?

    While it does state:
    (a) Prohibitions. - Except as provided in subsection (b) or (c) of this section, it is unlawful for a person to do any of the following:
    (1) Transport an assault weapon into this State.


    Subsection c (the exception?) states:

    (c) Exceptions. -
    (3) A person who lawfully possessed, or completed a purchase of an assault weapon prior to [the effective date of this Act], may possess and transport the assault weapon on or after [the effective date of this Act] only under the following circumstances:
    a. At that person’s residence, place of business, or other property owned by that person, or on property owned by another person with the owner’s express permission.
    b. While on the premises of a shooting range.


    To me this seems to make it legal to transport my assault weapon that was lawfully acquired prior to today between my home and a range in DE. Please correct me and show me where I've got this wrong - because I would very much like to shoot at my "assault rifles" at Bridgeville, but I do NOT want to run afoul of this new law (before it is ruled unconstitutional).

    Let's say you live in Delaware and you have the certificate of possession. But, you want to go shooting in Maine. If you get out on the highway, drive towards Maine, and you get pulled over - you would be in violation because you are not transporting between the places specified in the law.

    But it also says if you possess it before the effective date it can be transported to the range. Seems to contradict itself.

    Must have been written with help from the MGA.

    As I understand the new law. No semi automatic rifles with a detachable magazine May enter the state of DE.
    If it leaves for any reason it may not lawfully come back to Delaware.
    So if an out of stater enters Delaware with a semi automatic it must be either a Garand or tube fed rifle. A Johnson rifle would probably be okay.
    No magazines of any kind that can hold over 17 rounds.
    No semi automatic shotguns with a folding or telescopic stock.
