    I recently had my juvi record expunged and am looking to purchase my first firearm after getting my HQL but I’m nervous my purchase will get denied even though my juvi record has been expunged

    Juvi record expunged? Maybe I'm naive, but I thought those were sealed once you reached the age of maturity. Musta been some record...

    Expunged means expunged.

    Others may argue this point, but if you were successful in obtaining your HQL (passing the multitude of background checks that go into the HQL application), then you are probably good to go.

    And what outrider said... expunged means expunged. The only caveat being that I have heard it can take 90 days for the databases to be updated, so you may want to wait 3-4 months for good measure if it was just expunged. But since you've already gotten your HQL, I think you are fine.

    Oh and stay out of trouble.

    He does not yet have an HQL. I agree, if he gets the HQL, the gun purchase should be trouble free.

    I can't say as to whether or not it will get denied, because a lot hinges on the disposition (guilty, PBJ, Nolle Pross, etc...), whether it was heard in juvenile court or "adult" court, and the actual charges.

    The 77R is required for handgun purchases, after you get your HQL. You should read these questions carefully to be sure you know what you're getting into. For example, Question #4 asks if you've ever received a PBJ for a crime of violence, but it goes on to say "this does not apply to an expunged PBJ." Question #14 asks if you are a "habitual drunkard" then goes on to define that as someone who has been found guilty of 3 alcohol related crimes, 1 of which was in the last 12 months.

    You need to read each question carefully - if you can honestly say "no" to the questions then you should be all set.

    My bad guys I was typing way too fast I do have my HQL I was just worried if my juvi record would get in the way even though it’s been expunged and I’m 26

    I believe there have been cases in MD where someone has their HQL and still they are denied on the application to buy a gun because of a juvie record. As I understood the explanation from MSP, it was because they do "deeper" research for a gun purchase than they do on the HQL.

    I also believe that MSP has stated they no longer consider an expunged Juvie record after age 30.

    Ultimately I believe the only way to know for sure is to apply and see what happens.

    As for whether to state you have a previous record on the handgun application, there is some disagreement there.

    Expunged records are not in the court system any longer however anytime you are arrested and fingerprinted, you are assigned an FBI number. Your FBI number never goes away and is always avaiable for a printed CCH (computerized criminal history).
