    All that may be assuming a level of competence on their part that doesn't actually exist. Based on the ill-informed discussions I've heard at MGA committee hearings, I wouldn't trust most of those half-wits to properly transpose a recipe for making hot water.

    "Equity" as applied to legislators. That's just so Maryland . . . except that it seems to be becoming universal.

    The level of intelligence, or even sense, that's being demonstrated by the more publicity-hungry members of Congress is little less than appalling. Couple that with the horrific media coverage, the mud-slinging and general level of slime both applied to and exuding from the candidates, and there's little to attract the more meritorious and competent to run for public office.

    "The ATF can’t arrest anyone for owning a pistol-brace-equipped gun.

    That’s the outcome of a ruling handed down by United States District Court Judge Matthew Kacsmaryk on Wednesday. He granted a motion to stay enforcement of the agency’s rule banning the possession of effectively all braced guns that weren’t registered earlier this year. He found the ATF exceeded its power when crafting the rule."

    "Judge Kacsmaryk has now taken things a step further in the related Britto case. His ruling stays enforcement of the law as it applies to everyone across the country."

    "Late Wednesday, a Texas-based Federal District Court judge issued a nationwide stay preventing the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) from enforcing its rule on pistols equipped with stabilizing devices (2021R-08F)."

    "Judge Kacsmaryk stayed the rule in its entirety. The ATF is likely to appeal the decision. FPC, GOA, and SAF members were the only ones to whom the previous injunctions applied. Now, protection extends to everyone in the nation."

    So the question is: if (among other things, like the "common use" issue, which is a whole other conversation) the ATF's entire approach to this violated administrative procedures law, does that mean their entire "free" tax stamp regime on this front is also just a never-mind-that-never-happened thing? If they pretend it's not, that sounds like another suit for clarity.

    As I've said from the beginning of this charade, I couldn't be touched. I still took my braced pistols to any range or land I wished in any state I wished because they were not NFA items. The "rule" was illegal and was to be ignored, which is exactly what the vast majority of Liberty minded people did. The net effect was that approximately 250,000 rubes registered their braced pistols and created NFA firearms with a bunch of restrictions on them that do not apply to those who refused to comply.


    A little speech by one Patrick Henry that should be required reading for every American from the time they are able to read.

    It's not at all clear this is the case. The judge enjoined the rule in its entirety. Likely including everything the rule created, including those non-standard email-only pseudo stamps. I suspect another round of motions of some sort to clarify. Sounds like all of that just goes away because the rule that defined the process and the output is gone (assuming the ATF doesn't appeal and prevail in a higher court).

    If everyone would bother to read the vast volumes our Forefathers wrote for decades after 1787 about how and why they wrote the Constitution the way they did, every citizen's path through these tumultuous times would be lit as brightly as the noonday sun. They literally gave us clear instructions about how to react to each and every situation that may arise relevant to the common man. When you start quoting the Writers and acting as they instructed you to act and you are labeled a "seditionist" by the "government" for doing so, you KNOW we've gone off the rails and serious adjustment is needed. I live my Life as I was instructed to by those Great Men. If we all did the same, things would turn around without the need to result to extreme force. NEVER underestimate the power of mass non-compliance. A 1,000 men cannot control 100,000,000 men without their consent. Our forefathers understood this Truth and built a system to enshrine that. Live by it and you are truly Free.

    Well, close enough. But that obviously doesn't stop people from getting spuriously arrested and bankrupted or worse in the process, no matter how it turns out. Hence some caution on the part of some people with a lot at stake (like their careers, businesses, etc). We're still watching people rot in the DC gulag, right now, under entirely dubious (constitutionally speaking) circumstances. That's what we're up against these days. I'm very happy that we're seeing litigation wins on multiple 2A (and other contentious) issues.

    But cornered animals are dangerous, even if they're just being cornered in a federal district court over an administrative procedures law violation. There are a lot of people whose lives have been ruined in the last few years no matter what the founders might have said about whether they should have been. On that larger note, this won't be getting better on several fronts any time soon. Lawfare, administrative state overreach, and good old fashioned prosecutorial abuse is escalating wildly.

    No, I mean like people who have a security clearance, or who do work with agencies that won't touch them if they have some sort of ugly wake behind them with law enforcement. Ask people who are literally in DC prison right now completely broke and in solitary still waiting after two years for a trial. Those kind of people. It is odd you think they're some sort of chumps, or whatever it is that makes you so dismissive over what can and does happen if a federal agency gets a burr under its saddle about you, even over something seemingly trivial.

    Glad you spoke up. You hear stories everyday about someone getting their life wrecked by an overzealous prosecutor, at the end they may be found innocent great awesome, but even if you survive the over reach of the government you are never truly made whole after that. Look at Rittenhouse found not guilt but he still is dealing with the fall out.
