    I think I can SBR three lowers (for free) then once in hand/email/approved ask for a refund for three current SBR's and swap parts while waiting for a check! I have recieved refunds in the past for various reasons, it's easy.

    I think anyone with a current SBR can get a refund this way??

    This a probably gonna get me flamed, but I have been contemplating an SBR for a while. Should I go ahead and take advantage of the BS right now, or wait to see how things play out in court and file the old fashioned way?

    The rule hasn't been filed yet so the free tax stamp might not work yet. I'd hold off until it's filed.

    It must be added to your trust before the date the rule hits the Federal Register.
    I started the process for two today.

    5string, If the trust is going to register it, it needed to be in the trust before last week (not when the rule is published in the register.) The rule clearly states that date. If you didnt already have the pistol in your trust, you will have to register it as an individual if you want to do it tax free.

    That was a mistake that has since been corrected. Now, it must be in the trust before the rule goes into the federal registry.

    Why is that? What if I don't have a trust?
    I can't answer why but that is the way it is.
    You can file as an individual but that might cause problems for your heirs. I already had a trust so I only had to add the SBR to the list of properties and get the date notarized.

    What they are saying is all of these "rifles" with barrels less than 16" with any kind of "accessories" on the end of the rifle including braces are sbrs and need to have a tax stamp like they have always needed. You can either take the "accessories" off or convert it to a non sbr. But if you want to have the sbr then you have to get a tax stamp and the atf will give it to you for free because they are nice. The atf gave options other than registering them on a form1.

    Until someone challenges the nfa in court and says that sbrs are in "common use" and are "not unusual and dangerous" then the nfa will be law of land as passed in 1934.

    I agree this is bs. Its moving the goal posts after they ruled one way. You are right whats the point there 10 to 40 million out there anyway for over 10 years. To me It also shows the nfa and sbrs and not anymore dangerous than any other type of firearm. And they shouldn't be regulated by the nfa.

    It's the gun control lobby putting pressure on biden to "do something" biden got campaign money from them. he has to do something for them. This is probably the only thing the executive branch can do. They can re write definitions via atf rules. The question does he and the atf have the power. The courts will have to decide.

    I think the braces were illegal under GW Bush, then made legal under Obama/Biden, now being changed to SBR status for the braces under Biden.

    I understand this completely though. Unless the NFA goes away, the "pistol" brace is just an attempted work around from the required Form 1 and $200 for an SBR. We all know that the vast, and I mean vast, majority of people using pistol braces are so they can get around the NFA requirements AND still shoulder the weapon for stability purposes.

    Personally, I would love to see the NFA go away such that I can SBR and SBS whatever I want without it costing me additional money AND requiring me to jump through hoops. Would also love to buy an affordable MG. However, imagine the number of "retirement funds" that will implode if the NFA goes away and MGs are no longer ridiculously expensive. Some husbands will be getting some serious grief, just like I will be if Bianchi is a win for us. I told my wife about Bianchi and MSI's lawsuit over the HQL, and her response was, "So, you are telling me we didn't have to buy all those guns in 2013?" My response, "If we hadn't, Bruen never would have happened and we would not be looking at "assault weapons" being legal again and the HQL going away." Think she just decided it wasn't worth arguing about it. lol

    Yeah, but if he has other NFA Individually purchased items, it will be $200 a pop if he wants to move those into his trust. At that point, totally not worth it.
