In my state of NC, prior to 2012, we had a prohibition of transport, sale, and/or possession of firearms during a declared State of Emergency. Given our vulnerability to tropical weather, and winter weather, this statute was thankfully repealed (By Republican majority General Assembly and Republican Governor at the time, Pat McCory) and "restored" our 2A so that *ANY* SOE declared by any Acting Governor would NOT change what state law is in reference to the transport, sale or possession of a firearm. (We are a permitless state for Open Carry, so this effects anyone who wants to lawfully carry in some mannor!)

How big of a deal has that been? Well, under our DEMOCRAT Governor, we were under a declared SOE (Due to Covid) from March 2020 to August 2022. Imagine if that prohibition (no matter if you have a NC CHP, our Concealed Handgun Permit) had still been in place?

No more of a need than any other day of the week. But Declared SOE do give those with ill intentions some places as "soft targets" where 2A rights are severely restricted or prohibited.

The question is how hard to the overloaded authorities look for missing scumbags during SOE conditions. The answer in most rural areas is "not at all" to "not very hard". I have family that has been hit hard a few times by hurricanes in rural NC and the standard response is to hang a piece of plywood near the junction of the county road with "looters will go missing" on it. Most of the folks on their side road own tractors, backhoes, skid loaders, etc as they have 5-50acre properties and many have livestock. When Fran came through, the area was without electricity for over two weeks.

The Republic of Korea’s military is another key part of the story with regard to the Roof Koreans. It’s worth noting that virtually every weapon used by the Roof Koreans to defend themselves, their businesses, their communities and their families would be against the law or, at least, highly restricted today. “High capacity magazines” (anything over ten rounds) are against the law and there is a 10-day waiting period for all firearms purchases. Complicated.

Looting is often not a crime itself. You'd have theft, burglary, etc. type crimes occurring.

Most states (even including conservative ones) deadly force cannot be used to defend property. And especially not other people's property.

However, most states, with a notable few which are duty to retreat ONLY, you may not defend property with lethal force, but you MAY defend against forced felonies if you are in your residence (which also generally covers curtilage), which often times includes your business and your vehicle. Often this includes if you are a guest and may legally be there, that right extends to you. Castle defense. And this would include stand your ground. Stand your ground really only extends "castle defense" to cover outside of your house, business, vehicle. And you yourself would still need to feel at risk of imminent serious bodily harm or death. Stand your ground laws won't cover you if you see someone stealing stuff from someone's store unless the looters come at YOU.

Theft would NOT be covered. But burglary (breaking and entering) WOULD be covered.

So if it is your business, most states would cover you using lethal force if someone is trying to break in and steal stuff. If it is your house, like 46 out of 50 states would cover you for shooing a looter trying to break into your house. It is good to know the laws of the state where you own property.

One last note, few states would it be legal to discharge a firearm as a "warning shot". Even if it might be legal to use the firearm in self-defense.

I don't know about the laws in Florida but...

Florida Gov. Ron DeSantis said that the state isn't going to tolerate people trying to take advantage of those who have suffered after Hurricane Ian.

In case others have forgotten, MDGA passed a law, signed by MOM that purports to allow the Governor of MD to prohibit transportation of firearms during a state of emergency. The fat boy did not envoke this with the MD Covid SOE.
