    Air rifles with factory integrated suppressors are legal, but is it legal to build/install a suppressor for an air rifle that did not have one from the factory?

    IANAL, but since a lot of air guns come with what they consider to be suppressors (and many are removable), and there is no paperwork or background check, making something similar for a specific air gun should be okay as long as it cannot be installed on a real firearm.

    That's the key part I think. Since air rifles are not considered firearms by the ATF, the suppressor isn't regulated. But it has to absolutely not be able to be installed on anything the ATF considers a firearm.

    The thread pitch on air rifle barrels are totally different than those on ANY firearm. Hence, a suppressor made for an airgun will not readily thread onto a firearm.

    This is submitted to the National Firearms Act branch of BATF in duplicate, along with two sets of fingerprints from your local police station, two passport photos and a check for $200. Your local chief of police or equivalent law enforcement official is requested to answer two questions on Form 4. If he objects, he does not have to answer the questions and you don't get the silencer - that simple. If there is an appeal process, I was unable to find it.


    Fortunately the local police thing does not apply anymore. they're notified, but they aren't required to approve.

    You need to submit for a firearms silencer. ATF has no jurisdiction over airgun silencers unless they can be readily used on a firearm which makes them a firearm silencer. There was a court case about this a few years ago that opened things up for airgun silencers. Iirc, the crux of it is if it requires significant modification to be used on a firearm then it is not a firearm silencer. The argument was that many everyday items may be modified / manufactured into a firearm silencer ( oil filters, plastic bottles, etc.) but they are not a silencer until the modification is made.

    Ianal but based on this, it looks like the ATF is no longer pursuing removable airgun silencers as long as they can't be readily used in a firearm.
