    He is also not very popular over on OCDO, with good reason.

    But it would seem there's only 2 scenarios here, either the open carry law is struck down or the 9th essentially goes out on their own and proclaims the right is home-bound.

    Neither of which would be a bad thing.

    Or more likely that they'll declare that there is a right, but that the intermediate "two step" scrutiny allows it to be denied to nearly everyone.

    Or they decide there is some procedural flaw and punt. Never know with the 9th.

    The state has basically conceded on that point. You can bet they'd love nothing more than to have this Sent back to the district court and waste another 2 years.

    Arguments at CA9 right now, Nichols is not up yet. I can't link right now but Google 9th circuit live stream and click on the Pasadena link, it'll have judges Bybee, Berzon, and Gleason.

    Now I see why calguns.net were pissed at this guy.... horrible argument and may set the stage to go backwards with their rights in CA...
