In the left wing portion of the internet (you know, the part Al Gore invented) they are all in a tizzy that today is the day Obama could trump Trump and finally appoint Merrick Garland to the SCOTUS, replacing Scalia the author of Heller and McDonald, and giving the SCOTUS an anti-2A majority. At a minimum this would be a recess appointment for one year. At a maximum he would be a fully Senate-approved SCOTUS Member for Life.

Jumping right to the worst-case scenario the logic goes like this:

The 114th Congress expires at noon. At noon plus one second there will be 34 Democrats, 2 Independents that caucus with Democrats, and 30 Republicans, in other words 36 to 30. Rather than Vice President Biden turning the gavel over to Senator Mitch McConnell to swear in the new Members of the 115th Congress, Biden could gavel the current Senate Members that exist at that time into session, recognize Senator Dick Durbin as Majority Leader and turn the gavel over to him, and then Durbin calls for a vote on Garland. Republicans can stage a walk-out but a quorum exists, and the Senate can approve Garland to the SCOTUS ... for life. They can also pack the Federal Judiciary with all of Obama's other nominees who have been so left wing that they too never got a hearing.

More details are here, here and here.

Many on the left believe this is a perfectly legal interpretation of Senate Parliamentary Rules, though it would violate tradition. But if Obama didn't worry about violating the Constitution, why would he worry about violating tradition?

I hope they're all wrong. But if we dodge this bullet I know I'll feel a lot better at 1203 than I will from now up through noon.

The real question is will his party force this strategy. King Barry is going to do whatever he has to in order to please the party bosses, to ensure himself the retirement life of leisure and golf he wants.

That'd be a real Banana Republic move. I'd like to believe that the nation wouldn't stand for it. Of course, there's always the Scalia's Pillow counter-gambit. For a fee, the Clinton Foundation would, ah, undertake the job. So to speak.

-0- is going to the Hill tomorrow, ostensibly to meet with Dem leaders over how to save -0-care. How often has he gone to the Hill?

The Dems cannot be trusted. Look how they twisted the rules to enact -0-care without a single Repub vote.. Look how they rigged their own primary, then have the audacity to accuse others of interfering with elections.

They are desperate. Desperate people do desperate things.

I wouldn't trust them as far as I can throw them.

Why is Inauguration Day on January 20?
Until the Great Depression, lame duck presidents stewed screwed the counrty for much longer.

The 20th Amendment, which has been nicknamed “The Lame Duck Amendment,” was ratified in January of 1933. Among other things, this amendment shortened the time that politicians in both the Congress and the Presidency could remain in office after an election. The inauguration day for the president was moved to January 20, while the start date for Congress was bumped up even further to January 4. This two-week difference between the inauguration of new members of Congress and the incoming president was established to give Congress time to respond to a situation in which the regular voting process was unable to determine a president-elect, the candidate died, or some other scenario where there was no president to be sworn in.

I've been thinking about this (thanks for keeping me awake aray) ... speaking of tradition, what's so special about January 20 anyway ?

Trump should have just called up Chief Justice Roberts, say "meet me at the Capitol Steps ... bring your robe and Bible in twenty minutes," Then make another phone call to the White House Press Pool just to see how fast they can get their large, fat asses to sashay down the Capitol Mall, And afterwards have ObamaLlamaDingDong summarily escorted from the White House.

And when he's done doing that, tell the Press Pool "see you back here on the 20th for the party !!!

Charlie Brown trusted Lucy to hold the football, and after every time she pulled it away, he verified her newly changed intentions. That didn't work out so well, did it?

hussein doesn't give a tinker's dam about anyone but himself.

His future life is set as the (former) first black president (lower case intended).

I can easily see him weasel into the U. N. Secretary General spot.

And I can easily see him appointing Merrick.

That's better motivation than the whiff of an AMCap.

    Here to hoping....

The fact that none of us can, with confidence and assurance, say this would NEVER happen in our country is what's broken. We lack trust and confidence in our "leaders" to know and do the right thing.

Couple weeks and the next batter steps up to the plate. I'm ready for some real baseball.
