California Magazine Ban found Constitutional

The California 10+ round magazine ban has been ruled constitutional by an appeals court. No word on if the injunction will be lifted. This is a really bad sign. Heads up, they are trying to do this in MD too!

Am I missing something that this hasn't been big news?

post the actual opinion. These look like they relate to the equal protection claim, not the 2nd Amendment claim.

Also, this looks like the District court ruling, not appellate. There was already an appellate ruling on the 2nd amendment claim, which struck it down in July, but that is on appeal as well.

They got a LE exemption?

How does that pass constitutional muster under equal protection grounds?

Because when its rules, they don't apply to the gov't or its agents.

I read on Calguns that this one was a parallel case that was filed, and not the other one that's going on

Atleast they got a small victory in regards to the 1 handgun per month law


Alvin Doe, et al. v. Attorney General Xavier Becerra, et al.
2/8/18: VICTORY! The Third District Court of Appeal has published an opinion in our favor!

This lawsuit was filed to challenge an illegal California Attorney General / Department of Justice policy that ignores the text of state statutes and denies handgun sales to law-abiding people with both a Certificate of Eligibility & FFL03 (collector license).

Plaintiffs-Appellants argued that:

The DOJ’s Enforcement Policy Is Inconsistent With The Plain Meaning Of Section 27535.
Legislative History Confirms That The Licensed Collectors’ Exemption Applies To The Purchase Of Any Handgun.
Applying The Licensed Collectors’ Exemption To All Handgun Purchases Is Consistent With The Purpose Of The Statute.
DOJ’s Enforcement Policy Incorrectly Interprets Federal Law.
The Enforcement Policy Is An Invalid Underground Regulation.

And a judge appointed by Bush Sr. 100% of Democrat judges rule against rights, and at least half of Republican judges do too.
